sanitary sewer service, and location of new trees), the impact of the proposed
location on adjacent properties (minimal), and the presence of a wooded area to
screen the garage from the roadway. The Minor variance Committee concurred
that the proposed replacement garage is the best option from both a
functional and aesthetic standpoint.
3.3 The Minor Variance Committee unanimously recommended approval of a minor
variance to allow the placement of an accessory building in the front yard area of
a parcel at 2255 Cleveland Avenue Forth, based on the following findings:
1. Section 1004.02(D)(4) requires a front yard setback of no less than 30 feet.
2. Section 1004.01(A) requires accessory buildings to be placed in the rear
yard. Although the proposed location of the garage is in the rear yard area
of the property based on the orientation of the house, it is in the front yard
based on the definitions found in the City code.
3. The topography of the parcel, the location of the sanitary sewer service, the
wooded nature of the parcel, and the location of the house on the property
creates a physical hardship for the applicant.
4. It is the policy of the City to encourage reinvestment in residential properties
throughout the community.
5. The proposed variance is in harmony with the general purpose and intent of
the City's Comprehensive Plan and Title 10 of the City Code (Zoning).
6. The proposed variance, if granted, will not adversely affect the public health,
safety, or general welfare.
4.0 SUGGESTED CITY COUNCIL ACTION
4.1 By motion, approve Jeff& Trudi Martinco's request for a minor variance to allow the
placement of an accessory building in the front yard area of a property at 2255
Cleveland Avenue North, based on the findings of the Minor variance Committee
outlined in section 3.3 of this report.
Attachments: Property location reap; written statement from applicant; written consent from adjacent property
owners; sketch of property; proposed building elevation; photographs of property.
60-day Time Luna Application accepted on July 20, 1 998; Decision deadline is September 18, 1 998.
Prepared by: Kim L.
