Legislative Power, By enactment of this Chapter, the City Council hereby exercises <br /> its lawful 1 olice power and connnon law authority, and all statutory authority which is available <br /> F including, but not limited to, the powers conferred on it under Minn.i tat. § 237.162 and <br /> to it} me �, � franchises from ri right-of- <br /> way while reserving all power and authority to further' require <br /> s under Minn. tat. 16B.36, 222.37, 300.03, and 412.117 and other provisions of <br /> way user � <br /> law. <br /> Sec. 707.0 . Derinitions. <br /> following-definitions apply,in this Chapter of this Code. References hereafter to "sections„ <br /> The fol <br /> are unless otherwise specified references to sections in this Chapter. Defined terms remain <br /> defined terms whether or not capitalized. <br /> (a) means any �"Applicant" erson requesting permission to excavate or obstruct a right- <br /> of-way. <br /> (b) <br /> "Business District" mean that portion of the city lying within and bounded by the <br /> following streets: to be subsequently designated. <br /> (e) <br /> "City" means the City of Roseville, Minnesota. For purposes of section 707.28} city <br /> means its elected officials, officers, employees and agents. <br /> (d) "Management Costs i' means the actual costs the City incurs in managing its rights- <br /> of-way, includm' ' but not ffinited to costs associated with registering applicants; issuing, <br /> g <br /> ` and <br /> . <br /> processing, and verifying right-of-way permit applications; creating, maintaining <br /> updating mapping p systems; budget analysis; systems analysis; legal assistance; inspecting <br /> u <br /> pd g <br /> `job sites and restoration projects; maintaining, supporting, protecting, or moving user <br /> fac p g <br /> ilities during public right-of-way work; determining the adequacy of right-of-way <br /> restoration; restoring work inadequately performed; and revoking right-of-way permits <br /> d performing all other tasks required by this Chapter, including other costs the city <br /> an p g . . . <br /> may incur in rnanagIng the-provisions of this Chapter. <br /> (e)y <br /> "Degradation" means a decrease in the useful life of the right-of-way caused by <br /> excavation g <br /> in or disturbance of the right-of-way, resulting in the need to reconstruct such <br /> wa <br /> ri ht=of- earlier than would be required if the excavation did not occur. <br /> right-of-way <br /> (f) "Degradation Cost" mean the cost to achieve a level of restoration as determined <br /> _ <br /> b the City at the time the permit is issued,.not to exceed the maximum restoration <br /> show n M' plates 1 to 13, set forth in proposed PU rules parts 7819.9900 to 7 g <br /> g) .
