WORK SESSION AGENDA ITEM No. 4-A <br /> T0, Steve Sarkozy, City Manager <br /> FROM: Dennis Welsch, Community Development Direct N5P,110� <br /> DATE: June 8, 1998 <br /> RE: MINOR VARIANCES <br /> As an answer to the Minor Variance/Setback issues which eliminates the need for <br /> demonstration of a Variance "hardship", I suggest the following: <br /> Create a "single familyttvwo-family setback permit" process that uses the same minor <br /> variance process, but does not require variance and findings of hardship. It would only <br /> apply to principal structure setbacks and parking setbacks in lour density residentially <br /> zoned (R-1 or R- ). <br /> The "single family/two-family setback permit' could be approved by the staff or Council <br /> provided 8 of the following conditions are present: <br /> 1. One car garage or less is located on the site. <br /> 2. Improves the design or livability of the structure. <br /> 3. Improves the terrain or drainage issue. <br /> 4. The creed for the setback is not created by the current owner. <br /> 5. The existing improvements along with new improvements retain at least <br /> 65% of the pervious surface of the lot. <br /> 6. The permit creates no other setback or variance conditions or need. <br /> 7. The proposed addition improves the aesthetics and the functional use of <br /> the site. <br /> 8. Uses the same exterior structure materials and colors as the principal <br /> structure and accessories. <br /> 9. The building mass is consistent with those adjoining. <br /> 10. The building or driveway expansion does not place more vehicles <br /> adjacent to living quarter first floor bedrooms of adjacent home owners. <br /> The applicant shall provide drainage and roof gutters to guide water away <br /> 1 <br />
