REQUEST FOR COUNCIL A C TION
DATE: 06/08/98
ITEM NO- C-2
epart ent Approval: roared: Agenda Section:VJ LO !nVC CONSENT
ItV escription: Rodney Johnson request for a minor variance to reduce the setback
of a driveway to less than one foot at 2000 Wheeler Street North
1,0 REQ E LED A C TION
1.1 Rodney Johnson is requesting a minor variance to reduce the side yard setback of
a driveway to less than one foot (10") for the purpose of replacing an existing non-
conforming driveway at 2000 Wheeler Street North.
Requirement Proposal variance
Driveway setback " <1' setback 4` variance
BA R ND_
2.1 Rodney Johnson owns a home at 2000 Wheeler Street North. The property is
zoned R-1 Single Family Residential and adjacent land uses are single family
residential to the north, south, east: and vest.
2.2 Mr. Johnson is requesting a variance from Section 703.04(B)(9), city Code, to
reduce the setback of a driveway to less than five feet in order to replace an
existing driveway/parking area. There is a 12 foot wide driveway on the property
with a nine foot wide parking area on the side of the driveway.y. This parking area,
which has been in place for approximately 30 years, also extends along the side of
the single car garage. Earlier this spring: Mr. Johnson decided to replace the
existing parks ng pad, which was a combination of several materials (blacktop,
cement and river rock)wtith a concrete driveway. Unfortunately, the contractor he
hired did not obtain a building permit prior to undertaking the concrete work and the
project completed was without a permit. When Mr. Johnson was informed of this
p
oversight, he applied for a variance as well as a building permit for the concrete
l
work. This p arki n g II I area provides space for r. Johnson's second vehicle and
keeps the vehicle off of the street. Since nce the garage is only 10 feet from the
p rop e rty line, a variance would be needed for either a parking pad or for a driveway
extension to access the rear yard. The location of the house on the property
creates a p h sical hardship, while the single car garage presents a practical
difficulty for the applicant.
PF*3031 -RCA(06/08/98)-Page 1 of 3
