'III811F <br /> Item Description: Right-of-Way Management Ordinance <br /> Background: Over the past few months, the City Council has been considering the adoption of a <br /> new ordinance that would change how the City manages right-of-ways. The current draft of the <br /> ordinance is based on a model ordinance prepared by the League of Minnesota Cities. <br /> In addition to this right-of-way ordinance, the City is considering new franchise agreements for <br /> Cable Tv, NSP Gas and NSP Electric. The proposed franchise agreements contain many of the <br /> same provisions as this fight-of-way ordinance. Even though the proposed right-of-way ordinance <br /> differs to any franchise agreements, it males sense to consider adopting the right-of-way <br /> ordinance and new franchise agreements as a package. <br /> At the April 27, 1998 meeting, the Council continued consideration of this ordinance to the .tune <br /> 83 1998 meeting to allow time for the NSP and Cable franchises to be negotiated. Because <br /> negotiations on these franchises are not yet complete, it is recommended that consideration of this <br /> right-of-way management ordinance he continued. The franchise agreements are expected to be <br /> brought to the City Council for action on July 13, 1 998. <br /> RECOMMENDED COUNCIL ACTION: <br /> Motion continuing consideration of the proposed Right-of-Way Management Ordinance to July 13, <br /> 1998. <br /> Prepared by: Karl P Feel <br />
