REQUEST FOR COUNCIL ACTION
DATE: 06/08/98
ITEM • -
Department Approval: Mana er A roved: Agenda Section:
PUBLIC HEARINGS
Item bescription: Ness Kline request for a minor subdivision at County Road C-2 and
Long Lake Road (PF#3020).
1.0 afflUES TED ACTION
1.1 Hess Kline is requesting a minor subdivision to allow the subdivision of a 3.68 acre
parcel into a 1.72 acre parcel and a 1.96 acre parcel. The property to be subdivided
is located along the east side of the Minnesota commercial Railroad (Minnesota
Belt Line Railway company) right-of-way and south of County Road C-2. This case
was continued at the applicant's rFeq uest from the May 26, 1 998 meeting.
2.0 BACKGROUND
2.1 Hess Kline owns a 3.68 acre parcel located south of county Road C-2 and adjacent
to the Minnesota Belt Line Railway company right-of-way. The property is used for
vehicle storage, is designated as Industrial in the Comprehensive Plan, and is
located in an 1-1, Light Industrial District. Adjacent land uses include a combination
of industrial and commercial uses to the north, south, east, and unrest.
2.2 Mr. Hess is requesting a minor subdivision to allow the subdivision of one recorded
parcel into two parcels. The northern parcel will be 1.72 acres in size and the
southern parcel will be 1.96 acres in size. A sketch plan of the proposed
subdivision as well as new legal descriptions for the two resulting parcels have been
submitted in conjunction with the request. The two resulting parcels will meet the
minimum width (100 feet) and lot area (one acre)for an 1-1 zoning district- however,
the southern parcel will not have the required 100 feet of frontage on a public right-
way. The request is being made at this time in order to facilitate the sale of the
southern parcel to another party.
2.3 Numerous easements severely limit the use of the property. These easements
include an NSP easement for transformer towers and transmission lines, are Amoco
Oil Company easement, and a city of Roseville utility easement. The entire parcel
has been used for vehicle storage in the past; therefore, the exterior storage on the
property is classified as a legally existing non-conforming use of the property.
(Section 1007.02(B) states that all open and outdoor storage is prohibited in light
industrial districts.)
P# 020b- RCA(06/08/98) - Page 1 of 2
