In order to access the garage from this <br /> driveway: it cannot be roved further to the east unless it is moved further back on <br /> the lot. If the garage is roved further back on the lot, a mature sugar maple tree <br /> will need to be removed. The applicants are also concerned about maintaining the <br /> aesthetic value of the open area in the rear yard of the house. The location of the <br /> duplex on the property, the location of the exlsti ng driveway, and the location <br /> of a-mature Maple tree creates a practical difficulty for the applicants. <br /> 2.3 It is the policy of the City of Roseville to issue minor variances when there is a <br /> hardship or practical difficulty, provided the property is located in an R-1, Single <br /> Famil y Residential District, or R-2, Two-Family Residential District, and used for <br /> residential purposes. <br /> 2.4 Section 1 004■01, City Code, allows one major accessory building (game) and one <br /> minor accessory building (garden shed) in a residential district. This section also <br /> limits the area occupied by such an accessory building to not more than % of the <br /> required rear yard (the width of the lot x the 30 foot required rear yard setback). <br /> Section 70 .04(B)( ), City Code* states "residential driveways shall be constructed <br /> so that the edge of the driveway nearest to the side lot line shall be a minimum of <br /> five feet from the side lot line." <br /> 3.0 MINOR VARIANCE COMMI TT <br /> .1 The request for the variance included the required application form, sketch of the <br /> property and proposed driveway, written statement from the applicant, and written <br /> approval from the adjacent property owners affected by the variance (Harvey <br /> Nystrom at 190 Skillman Avenue West). <br /> 3.2 The Minor Variance Commfttee reviewed this request on Monday, May '18, 11 98, <br /> and unanimously recommended approval of a minor variance to reduce the setback <br /> of an accessory building to three feet for the purpose of constructing a single stall <br /> detached garage (14' x 221) and a variance to exceed the maximum allowed rear <br /> and building coverage to %, and a variance to approve a non-conforming <br /> drivewa y at 182-184 Skillman Avenue West, based on the following findings: <br /> 1. The location of the duplex on the property, the location of the existing <br /> ddvewa Y: and the location of a mature e iaple tree creates a practical <br /> difficulty for the applicants. <br /> 2. A blanket variance for the existing driveway was granted in 1 990.
