Wall, Mayor <br /> City of Roseville <br /> City Hall <br /> 660 Civic Center Drive <br /> Roseville,MN 55113-1899 <br /> Re: Proposed Roseville Right-of-Way Management Ordinance <br /> Dear Mayor and Council Members: <br /> This letter is to express the adamant opposition of Northern States Power <br /> Company (NSP) to the mandatory undergrounding portion of the proposed right-of-gray <br /> (ROW) ordinance on tonight's agenda enacting a new Chapter 707 to the City Code. I <br /> will further make other more general objections on behalf of NP. <br /> N P has been working with the League of A[innesota Cities (LMC) and with the <br /> Minnesota public Utilities Commission (NTUC) along with other interested participants <br /> to develop standards for the installation of essential service facilities in public streets and <br /> other public rights-of-way. The hearings before the PUC staff are scheduled to be <br /> completed on March 18'and 19'. It would be preferable to postpone the adoption of this <br /> ordinance until aver that date to determine if the participants are able to reach accord on <br /> the term of a model ordinance. is <br /> We understand that the City desires to have an ROW ordinance in place before <br /> this year's construction season commences m order to have a permit process in place for <br /> the potent instal ation of new telecommunication facilities. There is time to work more <br /> extensively on this and there is time to consider adoption of a much less formal and <br /> detailed ordinance requiring permits for new telecommunication facilities without the <br /> complexity of the proposal before you. However, if the City insists on proceeding, NP <br /> must strenuously object to the undergrounding provision, <br /> Proposed Section 707.23 will provide that all new construction, including <br /> replacement of old equipment, be done underground or be contained within buildings or <br /> other stmc res in conformity with applicable codes. (we fail to understand why any <br /> buildings are impliedly permitted within a public ROW), Under N P's tariffs filed and <br /> approved by the NTU , if a city requires installation of electric facilities underground <br /> that IMP would otherwise place overhead, the city must agree to pay the added cost of <br /> undergrounding before NP will proceed with construction.
