REQUEST FOR COUNCIL ACTION <br /> DATE: 3/10/98 <br /> ITEM ISO.: J-1 <br /> Department Approvali: Manager } <br /> rdi nano c s and Resolutions <br /> Item Descn"ptionop Right-of-Way Management Ordinance <br /> Bay round: At the September and November work sessions, the Council reviewed a model <br /> right-of-way ordinance prepared by the League of l innesota Clues which conforms to recent <br /> federal and state legislation. The ordinance was read by the Council on December 8, 1997 and <br /> January 26, 1998. <br /> The l innesota legislature required that the Minnesota Public Utilities omrru'ssion (NDUC) <br /> rides to standardize man of the aspects of right-of-war management. The current draft of <br /> adopt <br /> t ie ordinance is based on a model prepared bar the League of MYnnesota Cities. Recently, as a <br /> result of work with the VTUC rule making process, the League of Nfinnesota Cities has issued a <br /> new draft of the right-of-way ordinance which is significantly different than the one which our <br /> proposed ordinance is based. The new model ordinance is more closely aligned with expected <br /> NTUC rules. The new Model ordinance has been reviewed by the City Attorney's office and has <br /> been revised for the City of Roseville. A copy of the most recent draft is attached. <br /> Because the NPUC rulemaking process is not complete, it is likely that this ordinance will require <br /> changes in the future. with this understanding} it is recommended that the City adopt this version <br /> of the ordinance and revise the ordinance when needed. <br /> Motion adopting an ordinance adding Chapter 707 to the Roseville Code to administer and regulate <br /> l� g <br /> the use of public right-of-war. <br /> Prepared by: Karl P, Keel <br />
