9. The applicant and/or underlying property owner shall grant an access <br /> easement along the western edge of the property to the City to order to <br /> provide a public access from County Road B south to the McDonald's <br /> property. <br /> P & I CGUM15SION ACROW <br /> 5.1 On February 11, 1998, the Planning Commission herd a public hearing on the <br /> request. Craig Barnes, McDonald's Corporation, and Steve Halverson, NIPS, Inc., <br /> ►ere p resent to answer questions and provide additional information. No residents <br /> present commented on this request. <br /> 5.2 The Planning Commission discussed the proposed access easement along the <br /> western R ortion of the property. Concerns were expressed regarding the need for <br /> an easement for McDonald's at this time, since other easements are not in place. <br /> Concerns were also expressed regarding the need for an east-vest access between <br /> the north-south access being discussed and the frontage road. <br /> 5.3 The Planning Commission recommended approval of the request for a conditional <br /> use p ermit to allow the construction and operation of a new tale-out/self-service <br /> restaurant (McDonald's) at 2075 Snelling Avenue North, based on the findings <br /> outlined in section 3.1 of this report and with the 11 conditions outlined in Section <br /> 4.1 of this report, with condition #9 amended as follows (6-o): <br /> 9. The applicant <br /> MARIWArty shall cooperate with the City in efforts to develop an access <br /> easement along the western edge of commercial properties in this area from <br /> McDonald's north to County Road B (Change by Planning Commission). <br /> SUGGESTED f COLLNCLL ACTION <br /> 6.1 It is the olio of the city Council to accept public comment as time permits. <br /> p Y <br /> 6.2 By resolution, approve the request for a conditional use permit to allow the construction and operation of a new take-out/self-service restaurant (McDonald's) <br /> at 2075 Snelling Avenue North, based on the findings outlined in Section 3.1 of this <br /> report and with the 9 conditions outlined in Section 4.1 of this report: as modified by <br /> the Planning Commission (2111/98). <br /> Atachments: location map; notification map; notice of public hearing; site conditions/survey; site plan;grading <br /> & drainage plan; utility plan; planting plan; lighting plan- building elevations; photographs showing existing <br /> conditions and proposed new building image; later from craigan�esll�lcaonald's ; resolution. <br /> 60-day Time Limit:application submitted on January 12, 1998; application accepted as complete on January <br /> 2 , 1998; decision deadline is March 13, 1998. <br /> Prepared by: Kim L.
