McDonald's agreed to cooperate
with the City to discuss the concept of creating such an easement voluntarily with
the affected property owners. In anticipation of this request, the site plan prepared
by McDonald's allows a cut in the parking Mot to the northerly property with relative
ease.
At this time there are concerns with granting a blanket undefined access easement
which encumbers this property. The underlying issue is that the McDonald's
property is not adjacent or contiguous to County Road B without a series of
easement agreements with the several properties separating McDonald's and
County Road B. Currently there is not an easement format that addresses
proposed access areas, design standards for the access pathway, who would pair
for the needed improvements, and what provisions would be included to allow on-
going maintenance.
McDonald's corporation 1650 West 82nd street, Suite 900 Bloomington, MN 55431
