For two (2) years from the date of this Agreement, no amendments to the CITY'S <br /> Comprehensive Guide Flan or official controls shall apply to or affect the use, development <br /> density, site layout, or dedication requirements of the land included within the approved <br /> plat unless required by state or federal lair or agreed to in writing by the CITY and the <br /> DEVELOPER. Thereafter, notwithstanding anything in this Agreement to the contrary, the <br /> CITY may require compliance with any amendments to the city's Comprehensive Guide <br /> Flan, official controls, platting or dedication requirements enacted after the date of this <br /> Contract. <br /> 4.0 Approval by the CITY <br /> In approving the final development plan for the PHD and the final plat for Roseville <br /> Commons, the CITY hereby incorporates the following exhibits. The DEVELOPER shall <br /> develop the subject property as described or shown in these exhibits. If the exhibits vary <br /> from the written terms of this Agreement, the written terms shall control. City Street Tree Master Plan <br /> 5.0 Rezoning <br /> The CITY conducted hearings and meetings on December 10, 1997 (Planning Commission <br /> hearing on concept development plan), January 10, 11998 (City Council - meeting on <br /> concept development plan), January 12, 1998 (Planning Commission - hearing on <br /> preliminary plat), January 26, 1998 (city Council - meeting on preliminary plat), and <br /> February 9, 1998 (City Council - hearing on final development plan and final plat), to <br /> cons"der various aspects of the Planned Unit Development, including the plat of the subject <br /> property and rezoning of the subject property from R-1 single Family Residential to PUD <br /> Planned Unit Development. The CITY agrees to rezone the subject property to PDD, <br /> subject to the DEVELOPER's strict compliance with the approved plans, and the terms and <br /> PLI D/Subd Ivislon Agreement#(Mendota Homes, Inc.)- Page 2 of 10 <br />
