WHEREAS, the grading provisions require acquisition of certain <br /> right of way and temporary construction and slope easements prior to <br /> construction; and <br /> WHEREAS, the project will be submitted to the Minnesota <br /> Department of Transportation to determine the eligibility of the storm <br /> sewer f o.r state Aid funds * and <br /> WHEREAS,, the County has determined that there is justification <br /> and it is in the publics best interest to revise inglace traffic <br /> control signals with strut lights and Emergency vehicle Pre-emption <br /> on Hamline Avenue at County Road E (C AH 25 ) on Hamline Avenue at <br /> County Road B2 (CAH 78, west leg) (County Road 111 , east leg) , on <br /> Hamline Avenue at County Road C (CSAH ) ; and to revise inplace <br /> traffic control signals with street lights and install Emergency <br /> Vehicle Pre-emption on Hamline Avenue at Truck Highway 36 South Ramp <br /> (Commerce street) and on Hamline Avenue at Truck Highway 36 North <br /> Ramp* and <br /> WHEREAS, there exists in full force and effect Cooperative <br /> Traffic signal Agreements No. 87001 (Hand ine Avenue at County Road B) , <br /> No, 88012 (Hamline Avenue at County Road B2 ) , and No. 88013 (Hamline <br /> Avenue at County Road C) entered into by and between the County and <br /> City to share the maintenance and operation of t ra f f i c control signal <br /> systems with street lights and Emergency vehicle Pre-emption; and <br /> WHEREAS, it is anticipated that the Minnesota Department of <br /> Transportation will enter into an agreement with the City to maintain <br /> the Emergency vehicle Pre-eruption system on Hamline Avenue at the <br /> Trunk Highway 36 North and south Ramps. <br /> NOW, THEREFORE, IT IS HEREBY. MUT ALLY AGREED AS FOLLOWS <br /> 1 . The County shall prepare the necessary glans , <br /> specifications and proposals in accordance with the approved <br /> feasibility study. Costs of revisions to project items previously <br /> approved in the feasibility study will be paid for by the party <br /> requesting the revisions. <br /> 2. The County shall take bids, and with concurrence of the <br /> City, award a contract for the construction of this subject project; <br /> the County shall perform ttoe construction inspection; the City shall <br /> assist the County in the inspection of City utilities . <br /> 3 . The City shall Ftcquire all easements and rights of way, <br /> ..except rights of way per t ' +p i ng to railroads, required for the <br /> construction of the proje,a t f within the City. The County shall <br /> acquire rights of way pertain] -.g to railroads. <br /> 4 . The City shall pay for all easements and rights of way,, <br /> including rights of way pertaining to railroads , required for the <br /> construction of the project within the City. <br /> 92015-2 <br />
