distance from County Road C and will be adequately screened from
the street and adjacent properties. The tank will meet all state and
federal standards except that it exceeds the 6000 gallon size limit.
Staff has no objections to the 10,000 gallon size. It is also staffs
opinion that the above ground tank would be appropriate because the
tank could be more easily moved when the site is redeveloped in the
future.
3. ALTERNATIVES:
a. No change to the existing ordinance. The City would continue the
current policy of not allowing above ground tanks. outside the area
bounded by Cleveland Avenue, Highway 36, the west boundary of the
City and the north boundary of the City.
b. Adopt the ordinance change as outlined by the City Attorney. This
would allow the Council to review requests on a case by case basis
and attach appropriate conditions.
C. Amend the ordinance to allow above ground tanks as an interim use
of property. This would allow the City to review such installations
through the interim use permit process on a case by case basis but the
tank would be a temporary use of property vs. permanent use which
would be the case in the previous alternative.
d. Allow 'above ground tanks as a permitted use in the City and set
specific standards which must be met concerning location, screening,
and safety issues as required by the City Fire Marshal.
CONCLUSIQN AND RECOMMENDATION
1. Staff recommends approval of the attached amendment to Section 34.030 of
the City ordinance to adopt the language suggested by the City Attorney's
office with the addition of language to specifically outline conditions which
may be imposed by the City Council which includes a location on the site,'
screening requirements; as well as a time period which the tank would be
allowed on the site.
2. Staff recommends approval of a permit to allow Minnesota Coaches to install
an above ground diesel fuel storage tank at 1743 W. County Road C as
