SUPPLEMENTAL AGREEMENT <br />NO. 13 (Thirteen) <br />This Supplemental Agreement, made as of the 5th day of April, 1993, by and <br />between the City of Roseville ( "City ") and BRW inc., also doing business as BRW <br />Planning /Urban Design, Transportation and Engineering ( it Engineering ")• <br />WHEREAS, The City and Engineer entered into an Agreement (the "Prime <br />Agreement ") dated May 15, 1490, which contemplates work by the Engineer on a <br />project -by- project basis as specified by supplemental agreement; and <br />WHEREAS, the City desires that the Engineer undertake the City of Itoseville's <br />1993 --1994 Pathway Project. <br />NOW THEREFQRE, City and Engineer hereby agree as follows: <br />1. Engineer agrees to provide professional services specified on the Work <br />Program attached as EXHIBIT A pursuant to Section I(B) of the Prime Agreement. <br />2. City agrees to comply with its responsibilities under Section III of the <br />Prime Agreement and to pay Engineer monthly for services on an hourly rate basis as <br />detailed below, and as specified in Section V(A)(1) of the Prime Agreement plus <br />reimbursable expenses as specified in Section V(C). <br />3. Each part of the project shall not exceed the following amounts without <br />prior written approval. <br />(SEE ATTACHED COST PROPOSAL •EXHIBIT B) <br />4. To the extent any items contained in this Supplemental Agreement conflict <br />with the Prime Agreement, the Supplemental Agreement shall control for the projects <br />to be completed hereunder. <br />5.
