REQUEST FOR COUNCIL ACTION DATE: 2/08/93 <br />ITEM NO <br />Department Approval: Manager Reviewed: Agenda' Section: <br />Organizational Business <br />Item Description: Minnesota Police Recruitment system lawsuit. <br />Attached is a .letter from Bob Hell regarding the lawsuit commenced by <br />John Starts and Christopher Fields against the Minnesota Police <br />Recruitment System (MPRS) and thirty -six municipalities, including <br />Roseville. <br />Mr. Hell indicates that MFRS has retained the law firm of Holmes and <br />Graven to defend these lawsuits* He recommends that Roseville also <br />retain Holmes and Graven to defend the City, in the lawsuits. <br />COUNCIL. ACTION REQUESTED: <br />Motion that the City of Roseville retain the law firm of Holmes and <br />Graven to defend it in the lawsuits commenced by John Starks and <br />Christopher Fields represented by the law firm of Reinhardt & Anderson, <br />against the MFRS, City of Roseville and other municipalities. These <br />lawsuits arise out of allegations of liability incurred pursuant to <br />Minnesota statutes 363 and 419. <br />The City of Roseville agrees to pay a proportionate share of the <br />attorney "s fees and costs based upon the population of the City of <br />Roseville as it bears to the thirty -six communities who are members of <br />the MPRSO <br />The City of Roseville reserves the right to, at any time discharge <br />Holmes and Graven and retain other attorneys, including the Roseville <br />City Attorney, in the event any conflict arises from the defense of <br />this entire matter by Holmes and Graven, or in the event that the City <br />of Roseville feels that it would be in the best interest of the City of <br />Roseville to defend itself individually. <br />
