Councilmember Maschka requested that City Attorney Squires provide legal opinion prior to Council discussion, City Attorney Squires summarized the legal opinion dated November 12, 2003 related to filling Council vacancies, in consideration of the vacancy created when Councilmember Klausing assumes his elected position of Mayor after January 1, 2004 with less then two years remaining on his existing Council term. City Attorney Squires reviewed state statute related to timing of appointments and/or special elections and options available within the scope of the City Council directive and several scenarios related to candidate filing and public notification and Council declaration of the vacancy. Councilmember Maschka requested additional information as to accessibility issues; with City Attorney Squires responding to practical issues related to poll accessibility and timing related to voter turnout expectations. Councilmember Kough cited a sample City of Richfield ordinance, but City Attorney Squires pointed out that this city was a Charter City and would be under different statutory requirements that the City of Roseville. City Attorney Squires advised that whether or not a Primary was held for a Special Election was optional at the discretion of the City Council and resident preference. Mayor Kysylyczyn sought clarification from City Attorney Squires related to the candidate filing period not allowed less than 14 days after the declared vacancy; with City Attorney Squires requesting further research of that issue if that period were abbreviated or deviated from.
