4.0 APPROVAL by the CITY The CITY hereby approves the following plans on file with the City. The DEV "E OPER shall develop the subject property in accordance with these plans. If, however, the plans are inconsistent with the written terms of this Agreement, the written tee of this Agreement shall control. If the plans address items not specifically addressed in this Agreement, the plans shall govern with respect to those items. The plans are: A ertlf xcate of Survey indicating existing site conditions, dated 2003. hibit B Site development plan that includes property boundary, building setbacks, structure location (including the trash enclosure), curbing, and parking setbacks (each individual development project), dated September 5, 2003, Exhibit C Grading plan illustrating existing grades and those proposed after completion of the proposed construction, drainage directions, spot elevations, catch basins for surface water catchment, and the erosion control plan, dated September 5, 2003, Utility plan, including sanitary surer and water main illustrating all connections, pipe sized, line locations, manhole locations, hydrant locations, and other applicable utility plan infortnation, dated September 2003. Exhibit E Landscape plan including materials list, sizes and locations of all plant rnaterxals, dated September 5, 2003. Site lighting plan including specifications and lighting calculations for cooperative parking lot, dated 92003. Exhibit G Building floor plans (G, I — ) With dimensions of the faculty (by Ellerbe Becket) dated September 5, 2003. Exhibit H Building elevations (H) with dimensions and materials identified (y Ellerbe Becket) dated September 5, 2003. 5.0 REZONING The CITY conducted a combined heafing on April 2, 2003 (Planning Concession - hearing on Preliminary Plat, Rezoning, and Concept Development Plan) and on April 28, 2003 (City Council) to consider various aspects of the Planned Unit Development zone designation consistent with the City Comprehensive Plan and adopted Master Plan for the site.
