CITY of ROSEVILLE <br />PLANNED DEVELOPMENT AGREEMENT ' <br />This PLANNED UNIT DEVELOPMENT AGREEMENT, dated November 10 <br />F f '; I! into If Minnesota municipal M 2660 <br />Minnesota %Clvic Center Drive, RoseviHe, and 1 rth Heights Lutheran <br />Church, a not for profit organization, 2651 & 2701 Rice Street, Rosevil1e, Mn. 55113 <br />("DEVELOPER"), <br />IN DOW-11 <br />a # r <br />This agreement shall be effective upon completion of the following: <br />Passage and publication of Ordinance # rezoning of property to PUD <br />with underlying zoning of -1, Single Family residence District. <br />1.2 Publication of the ordinance in the St. Paul Pioneer Press, the CITY'S official <br />newspaper. <br />1.3 Execution & recording of this agreement by the CITY and the DEVELOPER. <br />The DEVELOPER has requested that the CITY approve a Planned Unit Development <br />(PUD) (PF# 3449) that redevelops the North Heights Lutheran Church property into a <br />two phases (Phase I and school &Phase II a sanctuary). <br />The Phase I address is 2651 Dice Street. The subject property, on which the <br />DEVELOPER'S project will be constructed, has the following legal description: <br />3,0 PUD APPROVAL <br />The CITY hereby grants approval of the Planned Unit Development (with plans as <br />identified in Exhibits A through H in Section 4 of this Agreement), subject to the <br />DEVELOPER'S compliance with the terms and conditions of this Agreement. The City <br />agrees to issue building permits, if said applications are consistent with the plays <br />identified in Section 4.0 below. <br />For any improvements not contemplated in this Agreement, the CITY may require <br />compliance with any amendments to the Comprehensive Guide Plan, official controls, <br />platting or dedication requirements enacted after the date of this Agreement. <br />
