Department Approval: City Manager App val Agenda Section: D Pw T REPORT Item Description: Report on Nuisance Code violations at 1 992 Cleveland Ave. 1.0 REQUESTED ACTION: Council action is necessary to resolve a City Code violation at 1 992 Clevcland Ave. The property is owned by Mr. Scth Eggessa. The staff has been working on this ease for over two years. The owner has completed most of the work necessary to bring the property into compliance except for one violation that, if left uncorrected, would adversely affect the adjoining property to the north. The owner has been notified of this agenda item and Council meeting by certified mail as required in City Code Section 407.06E, 2.0 project History 2.1 The home at 1992 Cleveland Ave. is occupied by Mr. Eggessa. 2.2 original code compliance items at the property included: I . The construction of a deck onto the front of the home which was completed aver the city sent notice (June 23, 2003) to Mr.Eggessa that a permit was required for deep and construction should stop (City Code Section 90 1.01 and Section 104.2.4 of the 1997 U.B.C.). 2. The construction of a new, enlarged, driveway with a gravel surface. Mr. Eggessa was notified (May 20, 2003) that permits are required for driveway construction and that approved surfaces are asphalt, concrete or pavers. 3. Building materials such as plywood, corrugated metal, wood truss joists and plastic buckets were stored on both the east and west sides of the garage (City Code Sections 407.02 D, 407.02 M and 407.03 H). 4. Several piles of cut logs and accumulated brush were located throughout the property including on the west, south and east sides of the garage and along the easterly property line (City Code Sections 407.02 D and 407.03 G). 5. A. drainage swale, required as a condition when an addition was added to the home in 1999, was incompletc and it encroached upon the adjoining property to the North (City Code Section 901.01 and T.E.C. Section 108.4). 6. Vegetation in excess of 8'} (City Code Section 407.02 Q. 2.3 At the July 21" 2003 City Council meeting the Cound I allowed Mr. Eggessa approximately two months, until the September 15'h Council meeting, to correct City Code violations before it would consider possible abatement action or the issuance of a court citation. Staff met with Mr. Eggessa and Mr. Gilbertson after this meeting. 2.4 At the September 15'h City Council meeting staff reported that most of the violations had been corrected by Mr. Eggessa and recommended continuing the abatement process and review through October 13", 2003 in order to allow Mr. Eggessa additional time. 2.5 Current status of code compliance items: 1.
