2. AL permit has been issued for the surfacing of a portion of the driveway. This work roust be <br />completed before July of 2004. <br />3. The outside storage of building materials and household item has been removed. This <br />item is complete. <br />4. Most of the cut legs and brush have been removed. This item is considered complete. <br />5. The drainage swale along the north property line remains incomplete. It has now been <br />properly dug and will divert storm water to the front yard and into the storm system, <br />however in its present state (with gust a dirt bean abutting the property line) the Swale will <br />erode dirt and mud onto adjoining property. Mr. Eggessa has been notified that additional <br />work must be performed on this swale. The City recommends that landscape blocks be <br />placed along the property line to a height of approximately 12" to control erosion. <br />6. vegetation in excess of 8'' has been cut. This item is considered complete. <br />3.0 SUMMARY of RECOMMENDATIONS: <br />3.1 Community Development Staff recommends that the Council approve the abatement of the <br />drainage swale violation (non - compliance with approved building plans — Pern-tit A99-1350) City <br />Code Section 901.01. This would involve the installation of approximately 50' of landscape wall <br />and the removal of approximately 2 yards of dirt from the site. <br />1. Staff has not received firm bids on this work as yet. It is estimated that the <br />total cost world be approximately $850.00. <br />4.0 BACKGROUND. <br />4.1 Periodically the Community Development staff reviews Code violations relating to property <br />maintenance to determine whether there are properties with continuing City Code violations for are <br />extended period. The staff spends time attempting to gain compliance during this time on these <br />properties. Generally they have not net the Code because the owner has been unable (physically or <br />financially) or unwilling to comply with the Code. property abatement is one remedy. It alloys the <br />city to order corrections and assess the property for the work. This process has been used in <br />previous gears to secure buildings from vandals and weather, clean up buildings, paint and/or <br />restore siding, plug rodent holes, repair windows and fir failing garage roofs and doors. <br />4.2 The staff attempts to work with property owners to bring the structure into compliance and <br />continues to encourage property owners to address the property repair issues and suggest <br />alternatives to the abatement process. The process is attached. <br />4.3 The City goals within the comprehensive plan are to protect and improve property values (goals 3, <br />4, and 5; page 6 and 7, Section 3 ) and to adhere to performance standards which protect the <br />integrity of con nercial areas and neighborhoods (Policy 6, page 8, Section 3). <br />4.4 This process has been successfully used in previous years to resolve long- standing nuisance <br />complaint violations. <br />4.5 The staff attempts to work with property owners to bring properties into compliance (and <br />continues to encourage property owners to repair properties up to the time of a Council hearing). <br />5.0 POLICY IMPLICATIONS <br />1A — 1992 Cleveland Ave. Page 2 <br />
