The Contractor shall be liable for penalty arnount(s) upon <br />determination of the City of Roseville that performance has not <br />occurred consistent with the provisions of the contract. The City <br />may deduct the full amount of any penalties from any payment due to <br />the Contractor. The remedy available to the City under this <br />paragraph shall be in addition to all other remedies which the City <br />may have under law or at equity. <br />Exctions: For the purposes of this Proposal, the Contractor shall <br />not be deemed to be liable for penalties where its inability to perform <br />recycling collection service is the result of conditions beyond the <br />control of the Contractor, including but not limited to civil disorder, <br />acts of God} inclement Breather severe enough that trues cannot <br />safely take collections, provided however, that the Contractor shall <br />obtain the approval for the delay from the Recycling Coordinator or <br />their designee prior to 4:00 p.m. o f the scheduled Collection Day. <br />23. Insurance <br />Contractor shall provide a Certificate tf Insurance as proof of general <br />liability coverage for bodily injury or death in the amount of $1 <br />million for bodily injury or death and in the amount of $200,000 for <br />damages to property. <br />The Contractor shall also provide a Certificate of vehicle Liability <br />Insurance in the amount of at least 1,000,000. <br />The Certificate of Insurance shall name the City as an additional <br />insured, and state that the Contractor's coverage shall be the primary <br />overage in the event of a loss. Further, the Certificate shall provide <br />for thirty -(30) days' written notice to the City before cancellation, <br />expiration, or change of coverage. <br />24. Workers Compensation <br />The Contractor shall provide evidence of workers Compensation <br />insurance covering all employees of the Contractor engaged in the <br />performance of the Contract} in accordance with the Minnesota <br />Workers Compensation Law. <br />25.
