23. Street Improvements: This Contract is subject to the right of State <br />of Minnesota, Ramsey County, or the City to improve their highways <br />and streets. The Contractor accepts the risk that such improvements <br />may prevent the Contractor from traveling its accustomed route for <br />the purpose of collecting recyclables. The Contractor agrees not to <br />make any claim for compensations against the City for such <br />interference. The City shall, whenever passible, provide to <br />Contractor information and instructions about how the Contractor <br />may best provide services in the improvement area. <br />24. Single Stream Pilot Program. Contractor shall provide the single <br />stream pilot program as specified in Para ra hs 20 and 21 of the <br />RFP. The program shad begin as soon as is practical as agreed by <br />the parties. <br />25. Publicity, Promotion, and Education: The Contractor and the <br />Recycling Coordinator shall work together in the preparation and <br />distribution of educational materials to insure accurate information <br />and program directions. Contractor shall pay for the design and <br />printing of a curbside program brochure for distribution to all certified <br />RDUs in April of each year during the term of the contract. City and <br />Contractor staff will develop the brochure. The Contractor will <br />provide and pay for 10,000 copies of the brochure. The City will be <br />responsible for the cost of mailing the brochure to all certified RDUs. <br />The Contractor will also be required to provide annually a one -page <br />flyer and a collection calendar for the City to distribute to the owners <br />of the MDUs. <br />Contractor shall demonstrate commitment to the promotion of <br />responsible waste management through participation in community <br />events, for example, by providing collection opportunity for <br />recyclables at City-wide Cleanup events. <br />6. Penalties: <br />a) Missed Collection <br />$25.00 for each missed collection moue three misses per <br />collection day, to be assessed at the end of each collection <br />month. A missed collection would be defined as a report by a <br />resident that their material was out by 7:00 a.m. and " the <br />address did not appear on the Contractor's conveyance sheet <br />as a "Late Set Out" and the recyclables were properly sorted. <br />13 <br />
