5.0 • <br />F <br />5.1 Periodically the Community Development staff reviews Code violations relating to <br />property maintenance to determine whether there are properties in disrepair for an <br />extended period. The staff spends tine attempting to gain compliance during this time <br />on these properties. Generally they have not met the Code because the owner has been <br />unable (physicalIy or financially) or unwilling to comply with the Code. A. Ramsey <br />County Court Citation is one remedy. It allows an impartial third party (Ramsey <br />County judge) to assess the situation and make a ruling. The Community <br />Development Department anticipates the judge will require the property owner to <br />repair or remove the dilapidated section of fencing. <br />5.2 This process has been successfully used in previous years to resolve longstanding <br />nuisance complaint violations. <br />5.3 The staff attempts to work with property owners to bring the structure into compliance <br />(and continue to encourage property owners to repair properties up to the time of a <br />Council hearing). <br />& 1 The Council has requested that each time a County Court Citation is considered to <br />resolve a long standing nuisance case, the Council review the case and provide <br />direction prior to authorizing the City Prosecuting Attorney to proceed. <br />6.2 The City goals within the Comprehensive Plan are to protect and improve property <br />values (Goal 3, 4 and 5; page 6 and, Section 3 ) and to adhere to performance <br />standards which protect the integrity of the housing units and the neighborhood <br />(Policy 6, page g, Section 3). <br />7;1 Staff recommends that the Council direct the staff to work with the city prosecuting <br />attorney to cite (Ramsey County Court citation) the owrter for the specific violations <br />of the Code. <br />7.2 Other options include; 1 ) Igo nothing — allow the violation and complaints to continue. <br />2) Proceed with a City Nuisance Abatement Hearing and repair the fence with city <br />funds, which is slower and takes more staff time. Also, in this case, the property <br />owners could repair the fence at minimal cost by doing the work themselves.
