I ORDINANCE NO. <br />2 STATE OF MINNESOTA <br />3 COUNTY OF RAMSE <br />4 CITY OF ROSEVILLE <br />5 <br />6 AN ORDINANCE AMENDING CHAPTER 104 OF THE <br />7 CITY CODE RELATING TO BACKGROUND CHECKS <br />g ON APPLICANTS FOR CITE' POSITIONS. <br />9 <br />10 THE CITY COUNCIL OF THE CITY OF RO EVILLE ORDAINS that the City <br />11 of Roseville City Code is amended by adding the new section 104.05(M). <br />1 <br />13 Section .05(M) is added as follows: <br />14 <br />15 M. Criminal History and Driving Record Background Checks. <br />1 <br />17 (1) The City of Roseville Police Dgpartment 'is authorized to conduct a <br />18 criminal histoa, and driving record back round investigation on any a lieant who <br />19 is a finalist fora paid or volunteer position with the Cily of Roseville. All finalist <br />0 golicants must provide the City of l Roseville with written authorization to <br />1 investigate the aollct's criminal history and driving record* and provide the <br />results to the pity Manager or designee. Any finalist .golicant who does not grant <br />23 the City written authorization to investite the a licant' s criminal history <br />24 driving record will not be considered for the position <br />2 <br />(2) Pursuant to Minn. Stat. § 364.05 if the golieant is denied employment <br />7 based on the findings of the criminal history and driving record back aund <br />8 investigation, the Cityshall inform the applicant in writing of the following: <br />9 <br />30 A. The g ounds and reasons for the denial or dis qualification } <br />31 E. The opportunity to request reconsideration of tljc�- City's decision and to <br />32 provide the City with eonlpptent evidence of rehahilitati "n and present fitness for <br />33 the pggition within five days of the notice of denial - <br />34 C. The applicable complaint and glevanee procedure as set forth in section <br />35 Minn. Stat. § 364.0 <br />36 D. The earliest date the person may regoly for a position with the City and <br />37 E. That all competent evidence of rehabilitation_ will be considered on <br />38 reapplication' <br />39 <br />4 This section shall goly to all positions of the CftL including those <br />41 represented by a bargaining unit, full - time, Dart -time and seasonal, and yvolunteer <br />4 as determined qpprpRn ate b the Cijyj. PgAgra h 2 of this section does not <br />43 apply to those positions listed as exceptions under Minn. Sjqt. ,,364.09. <br />
