I1 Or Department Approval-, Manager Reviewed: Agenda Section* r Presentations (tern Description: Final Leading and Enactment of Bus Bench ordinance Background: The Council enacted a transit shelter franchise.ordinance at the July 28, 2003, Council meeting. At that Council meeting, the Councii was also presented with proposed changes to the existing bus bench ordinance that would separate transit shelter governance from bus bench governance. These changes were supported by U.S. Bench Corp. the current bench provider in the City of Roseville. However, prior to that meeting the Council received an email from Outdoor promotions Inc., the shelter provider, requesting additional language changes to the bus bench ordinance. The Council tabled action on the bus bench ordinance for additional consideration of the concerns expressed by Outdoor Promotions. U.S. Bench Corp. requested that this item be brought back in September, as they were unavailable to attend August Council meetings. Discussion: Chapter 7 Section 703.05, of the Roseville' City Code concenlin bus benches - The staff- recommended proposed changes to this ordinance reflect the removal of reference to g transit shelters. Staff recommends a minor change to the amount of allowed advertising to accommodate standard bench panels per the request of U Bench. Minor changes were also made to the proposed language regarding review before the public works Commission of the annual permits for bus bench sites. Additional language was added to the bus bench ordinance regarding the placement of and frequency of emptying of trash receptacles at the sites if required by site conditions. All changes also allow bench placement indep Gent of the franchise shelter ordinance. please see Attachment A, which reflects staff` proposed language changes to this ordinance. All of these- staff ordinance changes were supported by U.S. Bench. The additional changes as requested by Outdoor Promotions are outlined in an additional version of the ordinance (Attachment B). The email from Outdoor promotions is also attached (Attachment Q. A copy of a letter from U.S. Bench Corporation stating their concerns about the changes proposed by Outdoor Promotions and their desire to continue to provide courtesy transit benches within the City (Attachment D)., RECOMAIENDED COUNCIL ACTION: Hold a final reading on, consider changes to, and move to enact an ordinance amending Chapter 7, Section 703.05, of the Roseville City Code concerning bus benches, and approve an ordinance summary for publishing.
