EXTRACT OF MINUTES OF MEETING OF THE <br />CITY COUNCIL OF THE CITY OF ROSEVILLE <br />Pursuant to due call and notice thereof, a regular meeting of the City Council of the City of <br />Roseville, County of Ramsey, Minnesota, was held on the 1 8th day of August, 2003, at 630 p.m. <br />The following members were present: <br />and the following were absent: <br />Council Member <br />introduced the following resolution and moved its adoption: <br />RESOLUTION NO. <br />A RESOLUTION APPROVING A 5 FOOT 2 INCH VARIANCE To SECTION 1005f01A2 <br />OF THE R05EVILLE CITY CODE FOR PROPERTY LOCATED AT <br />1881 HIGHWAY 36 WEST (PF3507). <br />WHEREAS} Vicorp Inc., (Rick Foerster) has requested a 5 foot 2 inch variance to Section <br />100 .01 A2 (Side Yard Setback) of the Roseville City Code to alloy the construction of a 5 feet <br />by 15 feet (75 sq. ft.) uni -sex restroom on the east side of the building located at 1881 Highway <br />36 and legally dcscribed as: <br />Part of Lot 1, Block 3, Rosedale Center Second Addition <br />2JUKU <br />WHEREAS, Section 1005.01 A2 of the Roseville City Code requires all side yard <br />setbacks to be a rninlrnum of ten feet ' from a side property line in this section of Roseville; <br />and <br />WHEREAS, the existing Vicorp Inc., principal structure lies 10 feet from the side yard <br />property line; and <br />WHEREAS, Vicorp Inc., desires to construct a 5 feet by 15 feet (75 sq. ft.) uni -sex <br />restroorn addition that would encroach 5 feet 2 inches into the required 10 foot side yard setback; <br />and <br />WHEREAS, the Roseville Planning Commission held the public hearing regarding the <br />Vicorp Inc., (Rick Foerster) variance request (Section 1005.0 1 A2) on August 6, 2W3, and <br />recommended (5 -o) approval of the request based on findings outlined in Section 5 and <br />conditions of Section 7 of the project report dated August 6, 2003. <br />NOW THEREFORE BE IT RESOLVED, by the Roseville City Council} to grant Vicorp <br />Inc. (Rick Foerster) a 5 foot 2 inch VARIANCE to Section 1005.01 A (Side Yard Setback) of <br />the Roseville City Code allowing the construction of a uni -sex restroorn in compliance to <br />Minnesota Accessibility Codes to a point 4 feet 10 inches from the east property line for property <br />located at 1881 Highway 36 West subject to the following conditions: <br />
