Regular City Council Minutes — 08/04!03 <br />DRAFT Minutes - Page 21 <br />City Attorney Anderson provided three options for Employee's Health <br />Council policy consideration of extending leave benefits Insurance <br />as deemed applicable. Premiums <br />Human Resources Director Eldona Bacon was present to <br />provide responses to Council questions. <br />Considerable discussion hook place regarding which <br />option as outlined was the most stringent; which was feast <br />restrictive; ADA compliance issues; court interpretations <br />related to long -term disability (LTF) disability benefits; <br />number of past and potential future applicable recipients; <br />discretion in applying benefits consistently to avoid any <br />appearance of discriminatory implications; and City <br />Manager discretion in determining essential position status <br />for employee positions. <br />City Attorney Anderson, when asked for his preference for <br />one particular option, responded that none of the three <br />created a comfort level related to potential for future <br />litigation. <br />Kysylyczyn moved, Maschka. seconded, tabling action on <br />an extended leave benefit policy until the August 11, 2003 <br />regular Council meeting. <br />Roll Call <br />Ayes: Klausing, Schroeder, Maschka and Kysylyczyn. <br />Nays: None. <br />X.
