REQUEST FOR CITY COUNCIL DIRECTION /ACTION <br />Item Descri Lion; Report on Nuisance Code violations at 1992 Cleveland Ave <br />1110 REQUESTED ACTION: <br />Council action is necessary to resolve numerous public nuisance violations and other city <br />code violations at 1992 Cleveland Ave. The property is owned by Mr. Seth Eggessa. <br />The staff has been working on this case for over two years. The owner has been notified <br />of this agenda item and Council meeting. <br />r I' Project HistorN <br />2.1 The home at 1992 Cleveland Ave. is occupied by Mr. Eggessa. <br />2.2 Code compliance items at the property include: <br />L The recent construction of a deck onto the front of the home which was completed <br />after the city sent notice (June 23, 2003) to Mr. Eggessa that a permit is required <br />for decks and construction should stop (City Code Section 901.0 1 and Section <br />104.2.4 of the 1997 T.B. C.). <br />2. The recent construction of a near, enlarged, driveway with a gravel surface. Mr. <br />Eggessa was notified (May 20, 2003) that permits are required for driveway <br />construction and that approved surfaces are asphalt, concrete or pavers. Work <br />continued and as of this date a permit has not been applied for (City Code <br />Sections 703.02 and 703.04.B.7). <br />3. Building materials such as plywood, corrugated metal, wood truss - joists and <br />plastic buckets are stared on both the east and merest sides of the garage (City Code <br />Sections 407.02 Dly 407-02 M and 407.03 H). <br />4. Several piles of cut logs and accumulated brush are located throughout the <br />property including on the merest, south and east sides of the garage and along the <br />easterly property lime (City Code Sections 407.02 D and 407.03 ). <br />5. A drainage swale, required as a condition when an addition was added to the <br />home in 1 999, remains incomplete and it encroaches upon the adjoining property <br />to the north (City Code Section 901.01 and U.B.C. Section 108.4). <br />6r Vegetation in excess of " (City Code Section 407.02 ). <br />3.0 SUMMARY OF RECOMMENDATIONS. <br />3.1 Conununity Development Staff` offers three alternative actions.
