continuation of public nuisances 407.02 D (debris) and 407.02 M (outside <br />storage), and, non - compliance with City Codes 703.02 (driveway permit), <br />901.01 (deck permit) and 901.01 (compliance with approved plans). <br />3.2 The long grass can be handled separately by staff under Section 407.08, <br />Accelerated Abatement, without further Council action. <br />4,1 By mofion, direct the staff to work with the city prosecuting attorney to . <br />Code. (Ramsey County Court citation) the owner for violation of the See <br />attached details. <br />5.1 periodically the Community Development staff reviews Code violations relating <br />to property maintenance to determine whether there are properties with continuing <br />public nuisances for an extended period. The staff spends time attempting to gain <br />compliance during this time on these properties. Generally they have not net the <br />Code because the owner has been unable (physically or financially) or unwilling <br />to comply with the Code. A. Ramsey County Court Citation is one remedy. It <br />allows an impartial third party (Ramsey County judge) to assess the situation <br />and make a ruling. The Community Development Department anticipates the <br />judge will require the property owner to do the clean up and to obtain proper <br />permits. <br />5.2 This process has been successfully used in previous gears to resolve long - standing <br />nuisance complaint violations. <br />5.3 The staff attempts to work with property owners to bn' ng the structure into <br />compliance (and continue to encourage property owners to repair properties up to <br />the time of a Council hearing). <br />6.1 The Council has requested that each time a County Court Citation is considered to <br />resolve .a long standing nuisance case, the Council review the case and provide <br />direction prior to authorizing the City prosecuting A.ttomey to proceed. <br />6.2 The City goals within the Comprehensive Plan are to protect and improve <br />property values (goal 3, 4 and 5; page 6 and, Section 3 ) and to adhere to <br />performance standards which protect the integrity of the housing units and the <br />neighborhood (Policy 6, page 8, Section 3). i <br />RCA ,1992 Cleveland Ave. page <br />
