(Ord. 275, 5-12-1959) <br />h. Upon relocation the building shall comply with the applicable require nts of the Minnesota State <br />Building Code as if it were a newly constructed building. <br />c. The proposed relocated building shall comply with the character of the neighborhood in which it is <br />being relocated, by being no less than 85%, nor more than 110 of the average height, width, and <br />length of the principle structures within 350 feet, on the sane side of the street. <br />d. The relocated use will not result in a depreciation of neighborhood or adjacent property values. <br />e. The relocated structure shall be ready for occupancy within six (6) months after relocation on the <br />site. <br />3. relocation Permit Required; Application: <br />a. Relocations, except to adjacent lots on the same side of the street, shall require a relocation <br />permit utilizing the notice and hearing procedure set forth for conditional use permits. b. The <br />applicant shall provide a performance security to the City in an amount to be determined by the <br />City Council, c. Chief Code Enforcement officer shall provide a report to the City Council and <br />after hearing the matter the City Council may giant or reject the issuance of a permit. (Ord. 1176, <br />11 -25 -1996) <br />Home Occupations: <br />1. Purpose: The purpose of the home occupation regulations is to provide an opportunity for home <br />occupations, while ensuring that such hone occupations do not have an adverse impact on the <br />character and livability of the surrounding neighborhood. The home occupation regulations also <br />ensure that the home occupation is secondary and subordinate to the principal residential use of the <br />property. <br />2. Standards: Horne occupations shall be subject to the following standards. <br />a. Home occupations shall only be conducted by -the resident of the dwelling, and within the <br />principal residential structure or dwelling. Not more than thirty percent (30%) of the floor area of <br />the dwelling, to a maximum of six hundred (boo) square feet, may be used for such purposes. The <br />home occupation shall be conducted entirely within the dwelling. An accessory building shall not <br />be used to operate a home occupation. <br />b. Only the resident owner(s) or tenant( s) of the dwelling, and not more than one nonresident <br />employee or full -time equivalent (FTE), shall be engaged in the conduct of the home occupation <br />on the premises at any time. For purposes of this provision, "nonresident employee" shall include <br />an employee, business partner, independent contractor, or other person affiliated with the home <br />occupation who visits or works at the site as part of the home occupation. <br />c. The home occupation shall be clearly incidental and secondary to the use of the dwelling for <br />residential purposes. Exterior alterations or modifications that change the residential character or <br />appearance of the dwelling to allow exterior business identity shall not be allowed. Interior <br />alterations or modifications that eliminate the kitchen, living room, any of the bedrooms or <br />bathrooms of the dwelling shall not be allowed. <br />d.. There shall be no exterior display or storage of equipment or materials used in the operation of <br />the home occupation. <br />e. The required off - street parking for the residential use shall not be reduced or made unusable by <br />the home occupation. The horne occupation shall have a maximum of two ( ) additional vehicles <br />to be parked on or near the property at any one time. <br />f. Shipment or delivery of products, merchandise or supplies shall be by single rear axle straight <br />trues or similar delivery vehicles normally used to serve residential neighborhoods. <br />g. Signage for the home occupation shall be subject to the requirements of subsection 1009.04A 1 <br />of this Title. t <br />h. The operation of the home occupation (except day care), as it is apparent to adjacent residential <br />uses and including the movement of business vehicles, shall begin no earlier than eight o'clock <br />(8:00) A.M. and end no later than eight o'clock (8:00) P.M. <br />
