5.1 Periodically the Community Development staff reviews Code violations relating <br />to property maintenance to determine whether there are properties in disrepair for <br />an extended period. The staff spends time attempting to gain compliance during <br />this time on these properties. Generally they have not met the Code because the <br />owner has been unable (physically or financially) or unwilling to comply with the <br />Code. A mosey County Court Citation is one remedy. It allows an impartial <br />third party (Ramsey County judge) to assess the situation and make a ruling. <br />The Community Development Department anticipates the judge Sri 11 require the <br />property owner to do the clean up and to make repairs. <br />5.2 This process has been successfully used in previous years to resolve long - standing <br />nuisance complaint violations. <br />5.3 The staff attempts to work with property owners to bring the structure into <br />compliance (and continue to encourage property owners to repair properties up to <br />the time of a Council hearing ). <br />1111 - ll Wcall lid 1 2-61- -l-1< <br />6.1 The Council has requested that each time a County Court Citation is considered to <br />resolve a long standing nuisance case, the Council review the case and provide <br />direction prior to authorizing the City Prosecuting ,Attomey to proceed. <br />6.2 The City goals within the Comprehensive Plan are to protect and improve <br />property values (Goal 3, 4 and 5; page 6 and, Section 3) and to adhere to <br />performance standards which protect the integrity of the housing units and the <br />neighborhood (Policy 6, page g, Section 3). <br />7.1 Staff recommends that the Council direct the staff` to work with the city <br />prosecuting attorney to cite (Ramsey County Court citation) the owner for the <br />specific violations of flie Code. <br />7.2 Other options include; 1 ) Igo nothing — allow continued deterioration and <br />complaints.
