2 c, Plannine File 3467: Request by Starbucks Coffee, 2305 Fairview, for a <br />3 CONDITIONAL USE PERMIT to allow construction of drive - through <br />4 service window at Fairdale Shoppes. <br />5 <br />Acting Chair Mu lder opened the hearing and requested City Planner Thomas Paschke <br />7 provide a summary of the project report dated May 7, 2003. <br />8 <br />Thomas Faschke advised that tarbucks' Corporation in cooperation with walpert <br />Properties (property owner) was seeping approval of a conditional use permit to allow the <br />installation of new drive -thru window and order board at their fast food convenience <br />12 restaurant at 2305 Fairview Avenue North. The property is currently occupied by a 1,600 <br />13 square foot coffee shop /caf &. The recently amended City Code identified this type of use <br />14 as a Class II Restaurant or Fast Food Convenience. The existing structure has 30 seats, <br />15 approximately 45 off - street parking spaces are allotted to this area, and there is room for <br />16 a drive -thru with a stacking capacitor of 6 vehicles. He explained the traffic flow <br />17 improvements, angle parking and islands. <br />18 <br />19 Based on findings, staff recommends approval of the request for a conditional use permit <br />20 to allow the construction and operation of a new drive-through facility at tarbuck }s 2305 <br />21 Fairview Avenue North, subject to the following conditions; <br />3 a. Submittal of a revised site, lighting, and landscape plan including the three curbed <br />4 islands similar to the plan designed by Staff (05/07/03)- the design of angle <br />5 parking in the south parking lot; parking and building lighting meeting Section <br />6 10 10, 1 of the City Code} additional plantings along the west and south property <br />7 line, including trees consistent with the City's Street Tree Faster plan. <br />8 b. Minor variations from the approved plans may be approved by the City's <br />Development review Committee, under the direction of the Community <br />30 Development Director; however, any substantial departures from the approved <br />31 plans will require an amendment to the conditional use permit. <br />32 c. All signage, including the menu board, for the project must comply with the <br />33 requirements of Section 1009 of the City Code, including the size and location of <br />4 gall signs, monument sign, and directional signs. <br />36 d. The curb along the front of the property shall be repaired and/or replaced. Paving <br />37 must be repaired by mill and overlay or other technique approved by the public <br />38 works Director. Because of the cars that will line up to use the window, <br />39 pedestrian access from and through the parking lot roust be clearly marked at the <br />40 entry paint by painting the pavement surface and caution signage near the front <br />41 door of the building- The site plan, curbs, islands and signage will be worked out <br />42 with staff. <br />43 e. Prior to a building permit being issued for redevelopment of the site, the applicant <br />44 shall post a landscape bond, letter of credit, or other security acceptable to the 4r <br />45 City, in are amount equal to 150% of the cost of landscaping, trash enclosures, <br />46 and site paving and curbing restoration.
