A. <br />MPM <br />Department Approval: Agenda Section: <br />DPW/CB Consent <br />Item Description: A Resolution Authorizing the use of Eminent Domain for the Terrace Drive <br />Extension as part of the Arona Site Redevelopment 45' . <br />IREOUE T : Con sid.ear app roving, by consent, a resolution authorizin g the use of eminent domain <br />for the Terrace Drive Extension as part of the Arona Site Redevelopment* <br />110 BACKGROUND: <br />1.1 On March 31 } 2003, the City Council approved a motion authorizing the City Attorney to take <br />all actions necessary to acquire street right-of-way required for the extension of Terrace Drive, <br />consistent with the council - approved Arona (Applewood Pointe) concept site plan and per the <br />attached minutes. <br />1.2 A condemnation notice was sent to the owners of Centennial Garden Apartments Vest on .Tune <br />5, 2003 for approximately 35 feet on the south side of the property for road right of gray needed <br />for the Terrace Drive extension. The condemnation notice begins the 90 day quick take process <br />for purchase of the right of way. If there are no objections filed against the notice of <br />condemnation, the City can take possession of the property for road construction as soon as the <br />first week in September, 2003. The quick take will not displace any residents at the Centennial <br />Garden Apartments west. <br />1.3 City Attorney is suggesting that a resolution be approved specifically for the road right of way <br />which is needed to provide a second public access to the Applewood Pointe project which will <br />include up to 130 new pausing units. In addition, the fire marshal is requiring that the public <br />road connection be made for fire protection access. <br />Staff recommends approval of the resolution, by consent, authorizing the use of eminent <br />domain for the Terrace Drive extension as part of the Arona site redevelopment. <br />3.0 SUGGESTED ACTION: <br />3.1 By resolution, authorize the use of eminent domain for the public right of way needed to extend <br />Terrace Drive to Arona Street as part of the Arona site redevelopment. <br />Attachment: Map of road right of way, draft resolution <br />Prepared bar: Cathy Bennet (490-224 I ) <br />FF3457 — RCA Terrace Drive Extension - 060903 Page I of l <br />
