1,?XTRACT OF MINUTES OF MEETING <br />OF CITY COUNCIL <br />OF CITY OF ROSEVILLE <br />Pursuant to due call and notice thereof, a regular meeting of the City Council of the City of Roseville, <br />Minnesota, was held in the City Hall in said City on Monday, March 31, 2003 at 6:30 o'clock p,rn. <br />The following members were present: .— and and the following were absent: <br />ounci lmember introduced the following resolution and moved its adoption: <br />"SOLUTION <br />RESOLUTION AUTHORIZING USE of CITY PROPERTY, <br />COUNTY DITCH NO. 41 FOR STORM WATER RUNOFF AND <br />DRAINAGE his FAIN OF THE <br />COUNTY ROAD C RECONSTRUCTION PROJECT <br />WHEREAS, the City of Roseville is the fee owner, manager, and operator of certain real property in <br />the City of Roseville, County of Ramsey, State of Minnesota, in the northeast corner of the County <br />Road C and Fairview Avenue, Just west of Herschel Street which is more particularly described on <br />the attached Exhibit "A " '),, hereinafter referred to as "Property "; <br />AND WHEREAS, one of the necessary public improvements as part of the County Road <br />Deconstruction project is the placement of storm water runoff into the existing drainage rights area <br />adjacent to Count} Road C on said Property; <br />AND WHEREAS, the City of Roseville hereby consents to the use of said land described on <br />attached Exhibit "A" for storm water runoff and drainage to be constructed as part of said Counter <br />Road C Reconstruction; <br />AND WHEREAS, the City of Roseville further declares that the storm water runoff and drainage <br />rights shall run with said real property and be binding on all parties having any right, title or interest <br />in said property or any part thereof, their- heirs, successors and assigns; <br />THEREFORE BE IT RESOLVED by the City Council of the City of Roseville, Minnesota, hereby <br />authorizes the use of the property described on Exhibit "A"' to be used for storm water runoff` and <br />drainage. <br />The motion for the adoption of the foregoing resolution was duly seconded by Member , <br />and upon a vote being taken thereon, the following voted in favor thereof* _ � and <br />, and the following voted against the satne: .. <br />WHEREUPON said resolution was declared duly passed and adopted. <br />
