8.3 All buildings, debris, and any soil contamination (subject to MnPA requirements) must be <br />removed from the site prior to the issuance of a building permit. <br />8.4 Dedication of lard for park purposes, right -of -ways, and any ponding or utility /drainage <br />casement required by the watershed or City must occur prior to the issuance of building <br />permits. <br />8.5 The Developer is purchasing the land from the City. A memorandum of understanding (MOU) <br />has been approved. The MOU is the basis for the purchase agreement and outlines the roles <br />and responsibilities of each party including parr dedication and purchase price. The Developer <br />must have land use approvals prior to closing. The construction can not begin until title has <br />transferred from the City to the Developer. <br />9.0 DETAILED STAFF RECOMMENDATION: <br />9.1 The City staff believes this project is consistent with the direction provided by the <br />Comprehensive Plan and the Arona — Hamline Neighborhood Master plan, which encourages <br />intergenerat ional housing diversity and mixed -use neighborhood revitalization. The staff <br />recommends approval of the preliminary plat, rezoning, and General Concept Planned Unit <br />Development based on the information and analysis provided in the project report dated March <br />31 a 2003. <br />10, 0 PLANNING COMMI SSIO ACTION: <br />10.1 On Mach 5, 20032 the Roseville planning Commission held the public hearing regarding the <br />United Properties general Concept Plan} rezoning and preliminary plat. <br />10.2 Mike Schneider addressed the Commission indicating his support for the project and asked <br />what was being approved for Phase 11 and what conditions were in place to guarantee <br />performance according to the plan. The City Planner indicated that a 36* unit, three story <br />condominium or 18 town homes within three roar styled structures was required for Phase ll, <br />with the setback limitations stipulated in Section 5.33 to 5.36 of the project report. (* The <br />Planner actually misspoke and said 30 units.) lair. Schneider also asked for assurances that the <br />extension of Terrace Drive would be drivable in time to allow the majority of construction <br />equipment and materials to enter the site from the cast or south, not along Arona Drive. <br />10.3 Sid Forrester addressed the Commission asking for details regarding a basketball court. Mr. <br />Carey stated that the current plan is indicated on the colored site plan rendering and that the <br />Parks Commission will have the ultimate recommendation of park amenities and location_ <br />However,, he indicated (Mr. Cary) that he will work with neighbors regarding design and <br />location o f play structures; <br />10.4 Commissioner Mulder indicated his concern over approving either of the two future uses for <br />Phase H without specific details.
