This letter surm- na-rizes those <br />options. I have attempted to point out the benefits of options where pertinent. <br />Minn, Stat. § 160.27 authorizes cities to regulate the placement of bus benches and shelters. <br />Subdivision two of Section 160.27 authorizes regulations by � i... license, perry -lit or franchise <br />Consequently, the Council could adopt an' ordinance or code provisions creating a process where <br />pert -nit or license would he issued for shelters and /or benches. The ordinance or code sections would <br />establish pe -I-fot -n ancc standards and 'Esmus and conditioins that would apply to each appiicaXAt. <br />Altemately, Section 160'.27 authorizes cities to penuit the placement of shelters and/or benches <br />through a franchise. Franchises are common in the utility /public service arena,, <br />r <br />In my opinion, a franchise is the most effective means available to the City to rcgulate shelters <br />and /or benches for tln-ce reasons. First, Section 160.27 clearly indicates that a franchise may he <br />granted on the condition the City receives a share of ad artising revenue. Second, dealing with <br />applications through a franchise scheme alto 8 the City, much like the PUD process, to use flexibility <br />to deal with the particulars of each request. Finally, it is my understanding the capital investment in <br />shelters requires a longer return period than a typical annual pennit. It seems more appropriate to grant <br />a franchise, rather than a 10 -20 year p ennit or license. <br />
