I - <br />14 101 � <br />Background.* In September of this year, the City Council, held heafings and assessed property <br />9 <br />owners for several improvements constructed in 1996., One project, P-961-06-24 I involved the <br />reconstruction, of Rose Place immediately east of Walnut Street. <br />During the assessment heafing for this project, the Council, approved a, reduction in the <br />assessment rate from $99.49 per foot to $54.60, per foot to account for the unassessable railroad, <br />I <br />il reduced the proposed <br />nght-of-way along the north side of this project. In addition, the Counci <br />assessment to the comer property on, Walnut Street owned by the 614 Company from $316,562.00 <br />to, $15,00615.00. <br />4ptspite the Council revisions, the 614 Company has appealed the proposed assessment to, District <br />Court. As, with all such appeals, staff has reviewed the assessment in more detail with the <br />0 a <br />property owner, the City Attorney and the City 51 s <br />ffort <br />appraiser in an, e to settle the appeal without <br />spending a great deal on, legal, appraisal and, court fees. <br />The 614 Company property has 672 feet of frontage on Walnut Street and 367 feet of fTontage on <br />Fkose Place. For assessment purposes, the City" s policy treats the Rose Place, frontage as the fron6 <br />of the lot which, les 100% assessable and the Walnut frontage as the side of the lot which is not <br />fully assessed. In 1989, the City reconstructed Walnut Street. The 614 Company'si frontage on <br />Walnut Street was assessed, for 53 7 feet of' Side lot +1i and not for its, entire length. <br />
