North Heights Hardware, case No. 2199 Page 4
C. Division of Platted Lot
If the issues related to the Comprehensive Plan
Amendment and rezoning can be resolved, the addition
of Parcel A to the existing North Heights lot is
quite straightforward. Parcel B is to remain a
single - family lot and the creation of this parcel
should meet the same test as any other lot split.
That test is simply whether this new lot to be
created will meet the standards in the R -1 District
and, if not, is it consistent with the character of
the surrounding neighborhood?
As noted, the lots fronting on Rice Street to the
south are very large; in many cases nearly two lots
wide. The lots behind the subject parcel are 95
feet, although there is one 75- foot -wide lot on
County Road C.
The lot to be created is 18,378 square feet. It is
well in excess of the required lot size. Its only
characteristics that will not conform to the R -1
standard is its 83 -foot width (85 -foot standard) and
a 7 -foot side yard setback (10 -foot standard).
d. Variances
Two variances are included as part of this
application. The first is to allow the addition to
be setback 7 feet from the west property line as
opposed to the required 20 feet. Previously we had
understood the building to be built on the lot line,
but the boundary survey shows a 7 -foot setback. The
constraints on the site would seem to constitute
sufficient hardship to justify this variance.
The second variance relates to the proposed 8.2 -foot
setback between the existing house and the new lot
line. This dimension resulted from the required
dimensions for aisles and parking stalls.
Landscamina
If you recall, the discussion
several months ago, there were
for this property in the past.
along with the variance applic
along Rice Street landscaped.
installed.
regarding the application
several variances granted
The site plan processed
3tion showed the frontage
That landscaping was never
