42 3. Restoration of Lydia Avenue.- Curb cuts and street cuts shall be reconstructed to match <br />43 existing street typical section. <br />44 a) Curbs proposed to be replaced shall have a minimum of 3 feet of bituminous saw cut <br />45 out to allow for proper compaction. <br />46 4. Erosion control. Prior to site grading and before any utility construction is commenced <br />47 or building permits are issued, the erosion control plan shall be implemented, inspected <br />48 and approved by the City. The College shall meet all requirements of the City's Erosion <br />49 Control Ordinance including but not limited to the followin6 . . <br />",V <br />50 a) No construction activity shall be allowed and no building permits shall be issued <br />51 unless the PUD development is in full compliance with the erosion control requirements. <br />52 b) Measures shall be installed in compliance with MPCA NPDES permit requirements. <br />53 c) The City shall inspect the site periodically and determine whether it is necessary to <br />54 take additional measures to address erosion. <br />55 d) To remove dirt and debris from streets that has resulted from construction work by <br />56 the College, its agents or assigns, the College shall sweep Lydia Avenue on a weekly <br />57 basis or more frequently as directed by the City Engineer until the site is stabilized. <br />58 College must sweep roadways with a water-discharge broom apparatus. Kick-off brooms <br />59 shall not be utilized for street sweeping. <br />60 e) If the PUD development does not comply with the erosion control plan and schedule <br />61 or supplementary instructions received from the City, after the College has received 48- <br />62 hour verbal notice,, the City may take such action as it deems appropriate to control <br />63 erosion. <br />64 f) The City will endeavor to notify the College in advance of any proposed action but <br />65 failure of the City to do so will not affect the College's or the City's rights or obligations <br />66 hereunder. If the College does not reimburse the City for costs incurred hereunder within <br />67 thirty (30) days, the City may draw down the letter of credit to pay any costs. <br />68 B. Development Plans. The public improvements shall be developed in accordance with the <br />69 following plans. The plans shall not be attached to this Agreement. The plans may be <br />70 prepared, subject to City approval, after entering this Agreement, but before commencement <br />71 of any work in this PUD development. If the plans vary from the written terms of this <br />72 Agreement, the written terms shall control. Notice to Proceed.
