Attachment A <br />I PUBLIC IMPROVEMENT CONTRACT <br />2 NORTHWESTERN COLLEGE <br />3 <br />4 <br />5 I. Parties. This Agreement, dated 2008,, is entered into between the City of <br />6 Roseville,, a Minnesota municipal corporation, of 2660 Civic Center Drive,, Roseville,, Minnesota <br />7 55113 ("the City"')�,, and Northwestern College, a Minnesota nonprofit corporation, of 3003 <br />8 Snelling Avenue, Roseville, Minnesota 55113 ("the College"')�. <br />9 It P.U.D. Approval. The City has approved the Planned Unit Development ##07-002 in an <br />I <br />10 agreement dated October 8, 2007 (the "PUD Agreement"'). The land is legally described as <br />I I follows.- <br />12 NE 114 of NE 114, Section 4, Township 29, Range 23 <br />13 <br />14 This Agreement governs the first phase of development contemplated in the PIT Agreement. <br />15 This first phase is referenced in this Agreement as the "PINT development"' or "development." <br />16 <br />17 111. Terms and Conditions of Installation of Public Improvements. In reliance upon the <br />18 representations contained herein; and in consideration of the mutual undertakings herein <br />19 expressed, the parties agree as follows.- <br />20 A. Public Improvements. The College shall construct the following "public improvements"' in <br />21 compliance with approved plans and specifications.- <br />22 1. Street Improvements. Street improvements include subgrade preparation, gravel base, <br />23 bituminous surfacing, and concrete curb and gutters. <br />24 a), The College shall construct an exclusive northbound right turn lane at the College <br />25 entrance. The intersection should be striped to include a southbound left turn lane <br />26 from Lydia to Lincoln Avenue. <br />27 b), The right turn lane shall be 140 feet long more or less with a 5.-1 taper. <br />28 c), The road shall be striped with a right turn arrow. <br />29 d), Unusable material within the roadway shall be removed by the College. <br />30 e), All sub grade excavation and filling shall be completed by the College in accordance <br />31 with MNDOT's specifications and the approved site grading and drainage plans. The <br />32 City reserves the right to test as necessary, at the College's expense, all grading work. A <br />33 test roll of the street subgrade shall be passed prior to acceptance of the subgrade by the <br />34 city. <br />35 2. Storm sewer construction.- The College shall construct all storm sewer improvements <br />36 necessary to serve the public improvement. <br />37 a), Storm sewer facilities shall be installed to meet City specifications and code. <br />38 b), All facilities shall be installed according the City details and specifications. <br />39 c), Biofiltration areas shall be protected from silt during construction. If these areas do <br />40 not function as designed, the College shall reconstruct them as directed by the City <br />41 Engineer. <br />Page I of 10 <br />
