<br />could provide a demonstrable basis, for that opinion and provide another area for
<br />important consideration, since the Council's, land use decisions, have to be legal
<br />and based on more than just opinions,.
<br />Councilmember Roe sought clarification from staff on the license application
<br />proces,s, and timing.
<br />City Manager Malinen advised that the applicant had applied for a pawnbroker's
<br />license, scheduled to come before the City Council at their May 12, 2008 meeting,
<br />pending approval of the CUP at tonight's, meeting.
<br />Pus,t moved, Ihlan seconded, DENIAL of a Conditional Use Permit (CLAP) for
<br />Ros,ewood Center Partners, (and Mark Smith, d/b/a Cash -n-Pawn) at 2189 Snel-
<br />ling Avenue (PF 8- 01.4)."
<br />Councilmember Pus,t thanked Mr. Smith for his presentations, to the Planning
<br />Commis,s,ion and City Council, for his communications, and his forthrightness,
<br />about his business. Councilmember Pus,t also thanked the community members,
<br />who came out to speak, expressing her pleasure in some of the things, she heard,
<br />but her displeasure in some of the other comments,, opining that some may have
<br />been slips, of tongue.
<br />Councilmember Pus,t clarified and apologized on behalf of those speakers, for
<br />anyone who may watch only a portion of this tape and any comments referencing
<br />"those people" or those living in apartment buildings, as being meth addicts,.
<br />Councilmember Pus,t noted that many are living in apartment buildings, based on
<br />different s,ocio and/or economic situations,, and many were good neighbors,.
<br />Councilmember Pus,t also thanked residents, for caring enough to come forward
<br />about an issue, and taking advantage of their democratic society.
<br />Councilmember Pus,t reviewed her interpretation of staff's, recommendation, and
<br />the criteria used in making we that recommendation; hover, outlined those areas,
<br />where she disagreed with their recommendation, and subsequent impacts, to the
<br />general public health, safety and welfare, and as identified and detailed in Section
<br />6.0 of the staff report dated April 28, 2008.
<br />Councilmember Pus,t noted her agreement with s,taff's, determination of criteria in
<br />Sections, 6. 2, 6.3, 6.4, and 6.7; however, disagreed with their recommendations,,
<br />and provided her findings, of fact for denial in Sections, 6.5 and 6.6., specifically
<br />as follows: the perception of residents, that "location, location, location" can affect
<br />a decrease in property values,- based on comments, and studies, identified by public
<br />speaker, Ms,. Cavanaugh, and referenced historic negative impacts, of those studies,
<br />to market values, of contiguous, properties,- even though part of the regulatory
<br />scheme, perceptions, were that the public was, not convinced that all thefts, were
<br />
