REQUEST FOR COUNCIL ACTION <br />Date: 2/14/11 <br />Item No.: 7. n <br />Department Approval City Manager Approval <br />Item Description: Approve Public Improvement Contract and Public Improvement Easement <br />and Maintenance Agreement for Applewood Pointe Of Langton Lake (PF <br />08-020) <br />11 BACKGROUND <br />2 The City Council has approved the redevelopment of the property at 2990 and 2996 Cleveland <br />3 Avenue North to develop a new 93-unit, assisted living facility. As a part of this development <br />4, United Properties will be constructing a public pathway, street, watermain, sanitary sewer, <br />5 streetlights, and storm sewer. <br />6 POLICY OBJECTIVE <br />"7 In order to ensure that the improvements are built to City standards, we have drafted a Public <br />8 Improvement Contract that defines the responsibilities involved with the proposed public <br />9 improvements. The improvements must meet all applicable City Standards for the construction. <br />110 Upon completion of the project, the developer's engineer must provide the City with ss-built plans. <br />11 They must also provide to the City Engineer a letter certifying that the improvements were <br />12 constructed according to approved plans and specifications, and request that the City accept the <br />13 improvements. One the City Council accepts the improvements, the two-year warranty period will <br />14, begin. <br />15 The Public Improvement Easement and Maintenance Agreement defines the future maintenance <br />116 responsibilities for the improvements to the site. <br />1 ��7 FINANCIAL IMPACTS <br />11 111",,'11 All costs associated with construction of the new public improvements necessary for this <br />119 development will be borne by the Developer. A 8,100 City Coordination fee is required. <br />20 Appropriate surety will be provided for all public improvements in the amount of 125% of the <br />2 1 construction cost, for a total of $,506,250.
