The improvements shall be installed in accordance with City details, standards, 6 and ordinances. The plans and specifications shall be prepared by a competent registered 7 professional engineer, furnished to the City for review, and approved by the City Engineer. 8 1. The Developer shall obtain all necessary permits from the Minnesota Pollution Control 9 Agency (MPCA , Minnesota Department of Health (MDOH)�, and other agencies before 10 proceeding with construction. Copies of these permits must be provided to the City I I Engineer. 12 2. The Developer or his engineer shall schedule a preconstruction meeting at a mutually 13 agreeable time at City Hall with all the parties concerned, including City staff, to review 14 the program for the construction work. 15 3. The Developer represents to the City that the plat complies with all City, County, 16 Metropolitan,, State and Federal laws and regulations including, but not limited to.- 17 subdivision ordinances,, zoning ordinances and environmental regulations. If the City 18 determines that the plat does not comply, the City may, at its option, refuse to allow 19 construction or development work in the plat until the Developer does comply. Upon the 20 City's demand, the Developer shall cease work until there is compliance. 21 22 F. Time of Performance. The Developer shall install all required improvements enumerated in 23 Paragraph C which will serve the plat by October 15, 2011, The Developer may, however, forward 24 a request for an extension of time to the City. If an extension is granted, it shall be conditioned upon 25 updating the security posted by the Developer to reflect cost increases and the extended completion 26 date. 27 G. Inspection. The Developer shall provide the services of a Residential Project Representative and 28 assistants at the site to provide continuous observation of the Contractor's work. 29 1. The Developer shall provide the City Engineer a minimum of one business day notice 30 prior to the commencement of the underground pipe laying and service connection; and 31 prior to subgrade, gravel base and bituminous surface construction. 32 2. Developer's failure to comply with the terms of this section shall permit the City 33 Engineer to issue a stop work order which may result in a rejection of the work and 34 which shall obligate the Developer to take all reasonable steps, as directed by the City 35 Engineer to ensure that the improvements are constructed and inspected pursuant to the 36 terms of this Agreement; and shall further result in the assessment of a penalty, in an 37 amount equal to I% per occurrence, of the amount of the security required for Developer 38 improvements. 39 H. Engineering Coordination. A City Engineering Coordinator shall be assigned to this project to 40 provide further protection for the City against defects and deficiencies in the work of the Contractor 41 through the observations of the work in progress and field checks of materials and equipment. 42 However,, the furnishing of such engineering coordination will not make the City responsible for
