I f) Tree Preservation Plan <br />2 g) Sanitary sewer, watermain, storm sewer and street plan. <br />3 h) Pathway, Retaining Wall and Fence plan. <br />4 <br />5 E. Notice to Proceed. The improvements shall be installed in accordance with City details, standards, <br />6 and ordinances. The plans and specifications shall be prepared by a competent registered <br />7 professional engineer, furnished to the City for review, and approved by the City Engineer. <br />8 1. The Developer shall obtain all necessary permits from the Minnesota Pollution Control <br />9 Agency (MPCA , Minnesota Department of Health (MDOH)�, and other agencies before <br />10 proceeding with construction. Copies of these permits must be provided to the City <br />I I Engineer. <br />12 2. The Developer or his engineer shall schedule a preconstruction meeting at a mutually <br />13 agreeable time at City Hall with all the parties concerned, including City staff, to review <br />14 the program for the construction work. <br />15 3. The Developer represents to the City that the plat complies with all City, County, <br />16 Metropolitan,, State and Federal laws and regulations including, but not limited to.- <br />17 subdivision ordinances,, zoning ordinances and environmental regulations. If the City <br />18 determines that the plat does not comply, the City may, at its option, refuse to allow <br />19 construction or development work in the plat until the Developer does comply. Upon the <br />20 City's demand, the Developer shall cease work until there is compliance. <br />21 <br />22 F. Time of Performance. The Developer shall install all required improvements enumerated in <br />23 Paragraph C which will serve the plat by October 15, 2011, The Developer may, however, forward <br />24 a request for an extension of time to the City. If an extension is granted, it shall be conditioned upon <br />25 updating the security posted by the Developer to reflect cost increases and the extended completion <br />26 date. <br />27 G. Inspection. The Developer shall provide the services of a Residential Project Representative and <br />28 assistants at the site to provide continuous observation of the Contractor's work. <br />29 1. The Developer shall provide the City Engineer a minimum of one business day notice <br />30 prior to the commencement of the underground pipe laying and service connection; and <br />31 prior to subgrade, gravel base and bituminous surface construction. <br />32 2. Developer's failure to comply with the terms of this section shall permit the City <br />33 Engineer to issue a stop work order which may result in a rejection of the work and <br />34 which shall obligate the Developer to take all reasonable steps, as directed by the City <br />35 Engineer to ensure that the improvements are constructed and inspected pursuant to the <br />36 terms of this Agreement; and shall further result in the assessment of a penalty, in an <br />37 amount equal to I% per occurrence, of the amount of the security required for Developer <br />38 improvements. <br />39 H. Engineering Coordination. A City Engineering Coordinator shall be assigned to this project to <br />40 provide further protection for the City against defects and deficiencies in the work of the Contractor <br />41 through the observations of the work in progress and field checks of materials and equipment. <br />42 However,, the furnishing of such engineering coordination will not make the City responsible for <br />
