1 7. Restoration of existing streets.- Curb cuts and street cuts shall be reconstructed to match <br />2 existing street typical section. <br />3 a) All unused curb openings along the Cleveland Avenue curb line shall be removed and <br />4 replaced with non- surmountable curb to match existing. Curbs proposed to be <br />5 replaced shall have a minimum of 3 feet of bituminous saw cut out to allow for proper <br />6 compaction. <br />7 b) Utility trenches shall be restored by the Developer per City standard plate <br />8 8. Streetlights. The Developer shall contract with Xcel Energy to construct public <br />9 streetlights within the plat. The streetlights shall be spaced consistent with City policy. <br />10 All costs to construct the streetlights shall be the responsibility of the Developer. The <br />I I Design and Agreement to install the streetlights shall be reviewed and approved by the <br />12 City Engineer prior to construction. <br />13 9. Erosion control. Prior to site grading and before any utility construction is commenced <br />14 or building permits are issued, the erosion control plan shall be implemented, inspected <br />15 and approved by the City. The Developer shall meet all requirements of the City's <br />16 Erosion Control Ordinance including but not limited to the following. <br />17 a) No construction activity shall be allowed and no building permits shall be issued <br />18 unless the plat is in full compliance with the erosion control requirements. <br />19 b) Measures shall be installed in compliance with MPCA NPDES permit requirements. <br />20 c) The City shall inspect the site periodically and determine whether it is necessary to <br />21 take additional measures to address erosion. <br />22 d) To remove dirt and debris from streets that has resulted from construction work by <br />23 the Developer, its agents or assigns, the Developer shall sweep Cleveland and <br />24 Langton Lake Drive on a weekly basis or more frequently as directed by the City <br />25 Engineer until the site is stabilized. Developer must sweep roadways with a water- <br />26 discharge broom apparatus. Kick-off brooms shall not be utilized for street sweeping. <br />27 e) If the plat development does not comply with the erosion control plan or <br />28 supplementary instructions received from the City, after the Developer has received <br />29 4�8-hour verbal notice,, the City may take such action as it deems appropriate to <br />30 control erosion. <br />31 D. Development Plans. The plat shall be developed in accordance with the following plans. The plans <br />32 shall not be attached to this Agreement. With the exception of the plat, the plans may be prepared, <br />33 subject to City approval, after entering the Agreement, but before commencement of Public <br />34 Improvement work in this plat. If the plans vary from the written terms of this Agreement,, the <br />35 written terms shall control.
