Staff has reviewed the tape of the September 15, 2008 <br />4, meeting and confirmed that the 26 foot road width is consistent with the City Council approval. There is <br />5 sufficient right- of- way to construct a 32 foot wide road if necessary in the future. We have also added <br />6 language to the contract to describe the driveway connection from the cul- de- sac to the Langton Lake <br />"7 parking lot. <br />8 The approved redevelopment of the property at 2990 and 2996 Cleveland Avenue North included the <br />9 construction of a new 93 -unit, assisted living facility. As a part of this development United Properties <br />110 will be constructing a public pathway, street, watermain, sanitary sewer, streetlights, and stonn sewer. <br />11 POLICY OBJECTIVE <br />12 In order to ensure that the improvements are built to City standards, we have drafted a Public <br />13 Improvement Contract that defines the responsibilities involved with the proposed public improvements. <br />'14, The improvements must meet all applicable City Standards for the construction. <br />15 Upon completion of the project, the developer's engineer must provide the City with ss-built plans. <br />116 They must also provide to the City Engineer a letter certifying that the improvements were constructed <br />1 ��7 according to approved plans and specifications, and request that the City accept the improvements. <br />11 111",,'11 Once the City Council accepts the improvements, the two-year warranty period will begin. <br />119 The Public Improvement Easement and Maintenance Agreement defines the future maintenance <br />2o responsibilities for the improvements to the site. <br />2i FINANCIAL IMPACTS <br />22 All costs associated with construction of the new public improvements necessary for this development <br />23 will be borne by the Developer. An $,8, 100 City Coordination fee is required. Appropriate surety will <br />24, be provided for all public improvements in the amount of 125% of the construction cost, for a total of <br />25 $,506,250.
