Attachment A <br />I PUBLIC IMPROVEMENT CONTRACT <br />2 APPLE WOOD POI. TE OF RO'YE VILLE A T LANG TO LAKE <br />3 <br />4 <br />5 <br />I. Parties. This Agreement, dated February _, 2011, is entered into between the City of <br />6 Roseville,, a1 Minnesota municipal corporation, of 2660 Civic Center Drive, Roseville, Minnesota <br />7 55113 ("the City"), and United Properties Residential LLC, a Minnesota limited liability <br />8 company, of 3500 American Boulevard West, Suite 200, Bloomington, MN 55431 ("the <br />9 Developer"). <br />10 11. Request for Plat approval. The Developer has asked the City to approve a plat of land to be <br />I I known as "Applewood Pointe oj'Roseville at Langton Lake " (also referred to in this Agreement <br />12 as the "plat"). The land is legally described as follows.- <br />13 See Legal Description attached as Exhibit A hereto. <br />14 <br />15 111. Terms and Conditions of Plat Approval. Now, therefore, in reliance upon the representations <br />16 contained herein; and in consideration of the mutual undertakings herein expressed, the parties <br />17 agree as follows.- <br />18 A. Conditions of Plat Approval: The Developer shall comply with any and all applicable City, <br />19 County,, Metropolitan,, State and Federal laws and regulations including, but not limited to.- <br />20 subdivision ordinances,, zoning ordinances and environmental regulations that may apply to the plat <br />21 and the development of the property contained in the Plat. <br />22 B. Land Use Approvals.- The plat consists of a senior cooperative building to be built in two phases, <br />23 with Phase I consisting of 48 apartment-style cooperative units, and Phase 11 comprising an <br />24 extension to the cooperative building consisting of an additional 44 apartment-style cooperative <br />25 units. The property is also to be improved with the following.- a pathway; a road and curbing; three <br />26 (3) storm water ponds; two (2) infiltration basins; sanitary sewer lines, water main lines and <br />27 hydrants, storm sewer lines with outlet control structures and flared end sections, and a retaining <br />28 wall and fence (collectively, the "Public Improvements"), <br />29 C. Public Improvements. The Developer shall construct the following improvements in compliance <br />30 with approved plans and specifications.- <br />31 1. Site Grading and Turf Restoration. Site grading improvements shall include common <br />32 excavation,, subgrade correction, embankment and pond excavation. Turf restoration <br />33 shall include seeding, mulching and erosion control. <br />34 a) The Developer shall submit to the City a site grading and drainage plan for the entire <br />35 plat acceptable to the City showing the grades and drainage for each lot prior to <br />36 installation of the improvements. <br />37 b) The Developer shall furnish the City Engineer satisfactory proof of payment for the <br />38 site grading work and shall submit a certificate of survey (as- constructed survey) of the <br />39 development to the City after site grading, with street and lot grades <br />40 c) All improvements to the lots and the final grading shall comply with the approved <br />41 grading plan. <br />42 2. Street Improvements. Street improvements include subgrade preparation, gravel base, <br />43 bituminous surfacing, and concrete curb and gutters. <br />Page I of 13 <br />
