Attachment D <br />81 At the request of Member Wozniak, Mr. Lloyd responded that City Code did not address Americans <br />82 with Disabilities Act (AIWA) requirements for residential properties such as this; but noted that <br />8'3 applicable requirements would be enforced through the Building Permit process. <br />&4 At the request of Member Wozniak, Mr. Lloyd responded that there was nothing the City Zoning Code <br />85 limiting residential occupancy, but that elsewhere in City Code; it was addressed for unrelated <br />86 occupants,, but no restrictions on family members. <br />8 7' Member Wozniak concurred with the comments of Member Gisselquist, and opined that the proposed <br />88 structural changes would enhance the use and value of the residence, without raising any significant <br />89 concerns for surrounding properties. <br />go MOTION <br />91 Member Gisselquist moved, seconded by Member Gottfried to RECOMMEND approval of the <br />92 proposed accessory dwelling unit as a CONDITIONAL USE at 2478 Hamline Avenue; based on <br />9'3 the comments and findings of Sections 4 and 5; and the recommendations of Section 6 of the <br />94 Request for Planning Commission Action dated March 2, 2011. <br />95 Ayes: 5 <br />96 Nays: 0 <br />9 7' Motion carried. <br />98 Mr. Lloyd advised that the case was anticipated to be heard at the March 21, 2011 City Council meeting, <br />99 but that their schedule was subject to change. <br />Page 3 of 3 <br />
