Attachment B <br />3. Uses existing on the effective date of this ordinance that generate greater Network <br />Trips than are allowed for such Block may continue to exist as a nonconforming use. <br />No expansion of such nonconforming use shall be allowed without compliance with <br />this ordinance. <br />4. Allowable Network Trips are not a property right and may not be transferred to <br />another Block. <br />C. Restriction on development.- The roadway infrastructure is not adequate for development <br />within the Twin Lakes Overlay District in excess of the Network Trips allowed in Section <br />E. Therefore,, development which exceeds the Network Trips set forth in Section E is <br />premature at this time. In order to provide adequate roadway infrastructure for <br />development which will generate Network Trips in excess of what is allowed in Section <br />E, it will be necessary to construct the Roadway Infrastructure Improvements described <br />in the AUAR and TLIIR. Therefore,, development on a Block that would exceed the <br />number of Network Trips allocated to such Block by Section E below may only be <br />constructed if the Roadway Infrastructure Improvements described in the AUAR and <br />TLIIR to accommodate the redevelopment of the Twin Lakes Redevelopment Area are <br />provided and/or paid for by the property owner(s) of such Block by one of the following <br />methods.- <br />1. The property owner(s) enter into a voluntary development agreement which includes <br />the payment of the Twin Lakes Roadway Cost Allocation Amount allocated to the <br />Block being developed in the manner set forth in Section D below. The decision of a <br />property owner to enter into a development agreement shall be completely voluntary <br />and optional on the part of property owner(s) of the Block to be developed. This <br />option is not intended to require property owner(s) to enter into involuntary <br />development agreements,, but rather to give property owner(s) a method by which <br />proposed development involving inadequate roadway infrastructure can be made <br />adequate byway of voluntary development agreements. <br />2. The property owner(s) make such other arrangements satisfactory to the City for the <br />construction of, and payment for, the Roadway Infrastructure Improvements. <br />In lieu of the foregoing options, the property owner(s) can postpone development on its <br />Block until all of the Roadway Infrastructure Improvements have been completed and <br />fully paid for. <br />D. Twin Lakes Allocation Cost.- In order to establish a method by which property owners)l <br />of property within the Twin Lakes Overlay District can develop a Block in a manner <br />which will generate more Network Trips than has been allocated to such Block under <br />Section E below,, the City has prepared and adopted the TLIIR. The TLIIR identifies <br />Roadway Infrastructure Improvements which are necessary to redevelop the Twin Lakes <br />Redevelopment Area, provides cost estimates for the Roadway Infrastructure <br />Improvements, and allocates the cost between the Blocks based on cost per Network <br />Trip. If development on a Block will generate Network Trips in excess of the number <br />allocated to that Block in Section E below,, the property owner(s), of such Block may, as <br />provided in Section C1 above, enter into a voluntary development agreement which <br />includes the payment of the Twin Lakes Roadway Improvement Cost Allocation Amount <br />allocated to such Block in the TLIIR,, as adjusted for the development to be constructed <br />on such Block using the methodology set forth in the TLIIR.
