Planning Commission Meeting <br />Minutes – Wednesday, April 06, 2011 <br />Page 11 <br />addition to being the parent of a 19 and a 13 year old, and his family’s frequent visits to <br />506 <br />the fast food spots along that corridor, and the current traffic flow as an “unmitigated <br />507 <br />disaster” at that intersection. Member Boguszewski concurred with Member Wozniak’s <br />508 <br />comments related traffic in that proximity and other business uses already in place, and <br />509 <br />the lack of validity for any argument related to negative traffic impacts from this use. <br />510 <br />Related to impacts on health, safety and welfare of the community and immediate <br />511 <br />neighborhood, Member Boguszewski noted that he would have liked to hear comments <br />512 <br />from the Police Department based on reality, not just perception. <br />513 <br />Member Boguszewski opined that there may need to be future consideration given to <br />514 <br />Zoning Codes, and whether to limit the number of pawn shops, or provide buffer zones. <br />515 <br />Member Boguszewski agreed that this application was totally different than the previous <br />516 <br />application; with the location not just immediately adjacent to residents, but also its entry <br />517 <br />spots into a residential street away from the front of the property. As a real estate <br />518 <br />professional, Mr. Boguszewski opined that perception could become reality, and potential <br />519 <br />perceptions that Roseville was a bad place to live based on multiple pawn shops and <br />520 <br />their related activities. Given public testimony, and the absence of any representative of <br />521 <br />the applicant present at tonight’s meeting providing comment, and Member <br />522 <br />Boguszewski’s personal opinion that he believed there was a problem with negative <br />523 <br />market values for contiguous properties, he spoke in support of staff’s recommendation <br />524 <br />to deny the request. <br />525 <br />MOTION <br />526 <br />Member Cook moved, seconded by Member Gisselquist to RECOMMEND DENIAL <br />527 <br />of the request for a pawn shop as a CONDITIONAL USE at 2057 Snelling Avenue; <br />528 <br />based on the comments and findings of Sections 4-6; and the findings of Section 7 <br />529 <br />of the RPCA dated April 6, 2011. <br />530 <br />Ayes: 6 <br />531 <br />Nays: 0 <br />532 <br />Motion carried. <br />533 <br />It was noted that this case is scheduled to be heard at the April 25, 2011 City Council <br />534 <br />meeting. <br />535 <br />Recess <br />536 <br />Vice Chair Gisselquist recessed the meeting at approximately 7:30 p.m. and Chair Boerigter reconvened <br />537 <br />the meeting at approximately 7:39 p.m. <br />538 <br />Chair Boerigter returned to the meeting at this time and resumed chairing the meeting; <br />539 <br />providing a brief explanation for recusing himself from the previous case, since his law <br />540 <br />firm, not him personally, did work with the property owner. Chair Boerigter advised that <br />541 <br />the property owner was not the applicant, to avoid any potential conflict of interest, he <br />542 <br />deemed it best to recuse himself from the discussion of that particular case. <br />543 <br />g. PLANNING FILE 07-068 <br />544 <br />Request by AEON for approval of a PRELIMINARY PLAT, PUBLIC EASEMENT <br />545 <br />VACATION and PLANNED UNIT DEVELOPMENT (PUD) Agreement Amendment <br />546 <br />related to the second phase of Sienna Green, a 50-unit apartment complex at 2775 <br />547 <br />Snelling Avenue <br />548 <br />Chair Boerigter opened the Public Hearing at 7:40 p.m. <br />549 <br />City Planner Thomas Paschke reviewed the request of AEON for a PRELIMINARY <br />550 <br />PLAT, PUBLIC EASEMENT VACATION, and PLANNED UNIT DEVELOPMENT (PUD) <br />551 <br />AGREEMENT AMENDMENT related to their previous June 8, 2009 approval. <br />552 <br />Mr. Paschke reviewed the original approval for a PUD for AEON to rehabilitate the <br />553 <br />Sienna Green apartments; and attempts since that time as AEON worked with the <br />554 <br />Minnesota Department of Transportation and the City of Roseville to acquire a small <br />555 <br />triangular piece of land directly north of the Sienna Green site, as detailed in Section 4.0 <br />556 <br />of the Request for Planning Commission Action (RPCA) dated April 6, 2011.
